How do you prove he was on drugs when he signed?

Reuters: The government said it has videos and photographs of Hunter Biden smoking crack or with drug paraphernalia as well as messages sent to purported street dealers arranging drug purchases. The evidence was collected from Biden's iCloud account, laptop and phone messages, prosecutors have said.
The government said it may call Hunter Biden's ex-wife, Kathleen Buhle, and other romantic partners to describe his addiction around the time of the gun purchase and possession.
Prosecutors said they plan to introduce excerpts from Biden's 2021 book, Beautiful Things, in which he described himself as a "crack addict" with no plans beyond "the moment-to-moment demands of the crack pipe."

How is that proof? You can not identify what someone is “smoking” on a video and what is the chain of custody of video. You need drug test with a positive result. Is Kathleen Buhle a doctor with extensive experience dealing with drug addition? Seems like lot of hearsay.

The state needs to proven he was on drugs when he signed the form and he thought himself to be an addict. In the very few cases where this has been charged the person was caught with drugs and failed a legal drug test. That is a very high bar. Biden was never arrested, never been tested for drugs and has not been caught with drugs.

Evidence doesn't have to definitively prove something in order to be admitted. It just has to make it more likely than not, and not be unduly prejudicial. The defense will be able to argue that there's no evidence the drugs in the videos were his, or what exactly he was smoking, etc, and the jury will then have to decide whether all the evidence together prove it beyond a reasonable doubt. From my reading on this, there seems to be a timing problem with a lot of the government's evidence. Most of their evidence of his drug use comes from a year or two after the gun purchase, so I'm sure Biden will say that just because he was using in 2019 does not mean he was doing so in 2018.

Maybe allowed to be admitted, but how could it hold up? I could get a piece of green cheese but wouldn't be able to prove it came from the moon.

Because evidence isn't viewed in isolation. As trial lawyers often say, "a leaf is not tree." A photo of a person with a crack pipe doesn't mean the person smokes crack. Perhaps it belonged to someone else. A text message to a dealer arranging a purchase doesn't mean a person uses crack. Maybe he was buying for someone else. But when you take all the evidence together, a jury can make a factual finding.

We are past that now. You just need to feel if it is crack.

Whether he is convicted or acquitted, I will most definitely not be voting for Hunter Biden in November.

Exactly. Every case I've ever seen has had a drug test for proof. The person is usually caught with distribution level amounts of drugs. This case is telling millions of Americans not to bother to overcome drug addiction.

No. There is so much fake propaganda about Hunter Biden. Look at the laptop and that computer shop owner who “copied” the fake laptop. All you have to do is show people are manufacturing photos, emails, etc and you have reasonable doubt.

Pretty sure this will be a case of jury nullification. The prosecutor is a partisan actor conducting a witch hunt and should be disbarred.

Hunter Biden’s laptop exposed 459 State and Federal violations. Every prosecutor in the jurisdiction of where these crimes were committed, were given copies of the report, along with every member of Congress.

The Report shows:

140 business-related crimes
191 sex-related crimes
128 drug-related crimes

He was merely charged with a few misdemeanors and a gun charge.

NO EQUAL JUSTICE if you’re a dirty, crime-ridden BIDEN!

No, they can't really make a factual finding. They can make a circumstantial finding, but not fact. Just because some dots are nearby to each other still doesn't prove they are actually connected.
