Biden said Trump didn’t have executive privilege anymore ages ago before anyone knew there were presidential records missing. It was regarding the January 6 records going to the committee. This is 11 months ago:

Biden didn’t waive Trump’s executive privilege, because Trump no longer had any executive privilege once he was no longer the sitting president. The minute Biden was sworn in, that executive privilege belonged to him, and was his to waive based on the best interests of the Presidency and the country. This is not unique to Biden and Trump, this is how it has been, in one form or another, pretty much since the US was formed.

Oh my god. The crimewave continues. These people need to be in prison. Just catching up on the latest details and I can’t even stomach the thought of what TFG, Patel et al. planned to do (or have already done?) with those documents. They had no right to remove them from the WH, and no right to keep them. Period.

Trump isn’t the President anymore and doesn’t have executive privilege. And by claiming that he does, he’s admitting that they are presidential records that he has no business having since he’s no longer the president.

I don’t assume that Trump was holding these documents for the purpose of interfering with another election, although it’s entirely possible. He may have also planned to use them to curry favor with certain foreign leaders for his own personal dealings.

Executive privilege is irrelevant here anyway. Executive privilege is based on the separation of powers, and can be used to prevent documents from being disclosed outside of the executive branch (usually to Congress). The disclosure here is just from one executive branch agency (NARA) to another (FBI). The letter makes this point, and cites the case where SCOTUS rejected a similar claim from Nixon. If Congress tries to get these records from NARA, then there might be a real executive privilege issue.

Another funny thing about Trump's filing is that it doesn't request a TRO or preliminary injunction or any other kind of emergent relief. I haven't practiced in SDFL, but in the courts I have practiced in, this means it will be handled in the ordinary course. Even if Trump wins the injunction he's asking for, it will be months from now. If the filter review isn't done yet, it certainly will be done by then.

There are probably more documents. They’ve probably already set sail to destinations unknown. Until they resurface months from now, edited and distorted, on the front page of the NYT of course. And TFG will say it was probably just some fat guy in his basement that did it. Wait….
