It is around 2:35. He tries to kick it out of the way, misses then throws it, then gets pushed pretty hard to the ground. Can't they call it even?

He should file charges of assault against the police for lobbing the tear gas canister at him in the first place. If it's assault to throw it back then it was assault to throw it at him.

You have to realize this holds no water.
