If this isn't overturned in an en banc rehearing, the appellate courts are going to get deluged will petitions for mandamus that they will deny, somehow distinguishing on the facts without coming out and saying that Flynn's petition was granted because he is buddies with the president.
And all sorts of defendants will run with DOJ's new "lying to the FBI is fine" statement. Will Martha Stewart appeal? |
