I don't think creating divisions between ourselves is the way to go. Everyone is scared. I had my second kid in Texas. I had life threatening complications and had an emergency c-section at 32 weeks. It was lucky to get to 32 weeks. I sometimes think of what would have happened if I needed an emergency c-section at 23 or 25 or 26 weeks. Would there have been hesitation? I have an older child. How far would the medical team risk it to avoid being sued or charged with murder if the baby did not survive? I am sure I am not the only one with a story. |

One thing I have been surprised by in this whole incident is that we haven't seen former Supreme Court clerks coming out of the woodwork to talk about procedure within the Court. Like, does the Court have audit control on its printers or documents? Does it have any non-networked printers? Are drafts password protected? Do certain Justices require a hard copy come to them in their chambers? Making a hard copy could be really hard to track. Are hard copies tracked and accounted for? Who has access to drafts as they work their way around the building? It also would not surprise me in the least if there were none of these security measures in place. In any case, unless I have missed it, I haven't seen any talking heads on TV discussing this. I have heard that former clerks have a listserv - maybe the were directed to or decided amongst themselves not to discuss procedures publicly. |
| It disturbs me that the severe pain of childbirth is left entirely out of the abortion debate. Forcing someone to go through that experience, ignoring all other aspects of forced pregnancy and parenthood, is literal torture. It is traumatizing for many women who voluntarily give birth to healthy babies with a smooth delivery. It’s an immense amount of suffering. |
There is no general listserve for former clerks. Maybe there is for more recent years. Clerks who clerked for a particular justice tend to have a communication method, as they will do reunions periodically with the justice. And clerks that clerked the same year tend to have a way to communicate. My info isn’t current but none of those security protocols were in place years ago….the justices depend greatly on the discretion of their clerks. Most clerks don’t even like to tell stories about their justices until they have passed on. Personally, I think the whole clerk system falls apart is the judges can’t trust the clerks to be discrete. I think the leak is pretty awful and won’t change anything …. Except maybe it gives D candidates a little more time to fundraise. |

I thought the hypothesis that it was a right wing leaker was crazy at first. But now I totally think it was. Kavanaugh or Gorsuch must have been waffling while Roberts was trying to recruit one or more to defect to his more moderate 15-weeks step-down of Roe. By leaking this, it will be public on who turned after the initial vote, and that person would be absolutely pilloried by those on the far right (think death threats). This is 100% to put pressure on none of them to defect. And now I see why rivets is so upset. He must have been close to avoiding this being the majority opinion.
So it’s either an ideological clerk on the right or Ginni Thomas from when Clarence was in the hospital. As much as I dislike ACB, Kavanaugh and Gorsuch- they maybe anti-women, but I don’t think they would further risk being seen as even more illegitimate by doing something like this. Clarance and Ginni don’t care and don’t think any rules apply to them. |

| We need to have more access to what is going on the supreme court. These people are very powerful with a lot of power over myself, my family.....all of us. I am glad for getting to see this document and think it a better idea that we all get to see the journey all these opinions go through. This should not be secret. |
