Black immigrant kids apparently tend to do well in high school & college. So if Black American kids get the right nurturing, they should be able to compete as well. Most of the Black kids grow up in Blue states in cities run by Democrats for generations. They go to schools run by woke administrators & are taught by woke teachers. Yet they need Affirmative Action to get in colleges run by woke Democrats. And its all the fault of the racist GOP. Huh?

Immigrants were given an education in their country, allowed to buy homes and were not dive bombed when their communities thrived.

So their parents have a leg up.

Unlike there poorly reasoned dissent by Justice Jackson, Justice Sotomayor's dissent does give some plausible yet weak constitutional arguments for favoring Harvard and UNC

Her big point is that the 14th amendment is not meant to be color blind. In get defense she cites several cases from the 1860's which were race conscious like the Freedmen's Bureau Act and were not thought to be against the 14th amendment.

The big flaw in her argument is that she cites the one example where SCOTUS has allowed race conscious laws: to correct and directly address actual state sponsored discrimination against a particular race. Citing laws from 1860's where the beneficiaries were actual former slaves to try and argue that the 14thn amendment is not color blind specially in the light of Title VI ( which Justice Gorsuch points out) that has been held constitutional makes her argument quite weak.

Harvard and UNC clearly violated Title VI, and if liberals want Title VII to apply to trans and gay folks then the same language in Title VI makes it very clear that Harvard and UNC can't discriminate based on race. End of story. Gorsuch makes this point very well in a takedown of Sotomayor's dissent

Justice Soromayor also leans on Justice Harlan's dissent in Plessey, but conveniently forgets to quote him saying that "Our Constitution, in COLOR BLIND..." which completely under cuts her argument

Her other main contention that it is the courts job to interpret the Constitution to ensure "racial equality" through "equal outcomes" is laughable and completely unsupported by SCOTUS precedent. The court cannot ensure not should it be an arbiter for equality the way Justice Sotomayor defines it. SCOTUS is only tasked with making sure citizens are treated equally before the Law. Nothing more, nothing less. Everything else is the Congress's mandate.
