She came here with her parents as an infant but lived all of her life here, went from preschool to high-school school here, was attending college here and was a permanent resident.


But she's somehow still an Indian citizen, and not an American.


Yeah I kinda have a problem with this. You refuse to be a citizen but use resources for citizens. If they are so loyal to India then they need to be petitioning India for help and resources. The United States is not good enough for them?

(I was a permanent resident too and obtained my US Citizenship as soon as I turned 18.)

It takes 5 years after Green card to get your citizenship. Given how long it takes to get GC for people on H1 visas, maybe she became permanent resident recently

I think most of Americans do not know how hard it’s for Indians to get Green card while being in H1B. Most people do not know the struggles. It takes minimum 10-15 years for you to get green card if you are an Indian . It’s because there is a rule of 7% cap country limit for Employment based green card. I m in this country from 2008 I’m not a citizen yet bcz I jgot my green card in 2022. I have to wait for 5 years to get citizenship. It’s not like Indians don’t want to be citizen. Fact is we can not become easily Bcz of 7% limit. Also Indians can’t participate in diversity lottery which many other countries can do.

You can look in department of state website - something called VISA bulletin which gets released every month. That data will tell and you will see Rest of world ROW as current . Only few countries like India Mexico China Philippines as not current. But India is most affected and in employment based green card there are 3 categories not everyone eligible for EB1 and if an Indian applied for green card in Dec 2012 they may file their final stage for green card now which might take another 6 months. EB3 Feb 2013 so u can see almost 10-15 years wait time . No one can tell . Next month DOS can retrogress date for India and can say people applied in Nov 2011 only can apply . It’s a hard and long process which no one else can understand but Indians.

But you can type visa bulletin March 2025 and look for Final Action date for employment based categories . Hope this helps . Nevertheless whether citizen or not Indians pay the same tax . Also in H1B you can not switch jobs easily until you get your green card. So for majority of Indians it’s minimum 12-15 years of wait time before they get their green card.

The first in first out rule does not apply here. Indian applied in 2011-12 still waiting but other countries if they applied in 2024 they can get it in 2025 . It’s a painful process .
