How are these people not in jail? They don't seem smart enough to commit all these crimes with no evidence and yet here we are!

I am obsessed with this story. What is taking the police so long to make an arrest, and bring these two back to Idaho? Three dead adults, and two missing kids. Just insane.
The kids' personal belongings were found in a storage locker, Lori has her daughter's cell phone. |
This poor kids are so dead. Ugh. The police need to find some evidence and quickly. |
| but even if the kids aren't dead, how is a parent no held by the police. I mean, if you child misses too much school you could be arrested. This mother can't produce her children or say where they are. What is the explanation for why she has not be arrested? |
They do not have enough evidence. They just found the storage locker and cell phone yesterday. Before that they didn't have physical evidence of a murder. Failure to produce the children would only make Lori found in contempt of court, but not enough to be extradited to Idaho without felony charges. Vallow & Daybell haven't answered any questions, so there isn't any lies to catch them in either. It's really strange, and for it to go on for months before anyone noticed... https://www.ktvb.com/article/news/local/idaho/rexburg-eastern-idaho-missing-children-vallow-daybell-no-charges-arrest-warrant/277-8adb1e65-ac31-473f-b8cd-bd208716a726 |
So minor children can just vanish and it isn’t a crime? Why don’t they throw her in jail for contempt if she won’t state their location? |
They could hold her for contempt if she was in Idaho. Idaho only extradites for felonies. I really think this case has the potential to change laws about missing children who have not been reported. |
But can’t the FBI take over? |
| Yes the FBI is involved. Honestly they sound like serial killers. |
So then maybe they can charge them with a federal crime and leave Idaho out of it, since they seem hapless. |
| What about truancy laws? The children are obviously not enrolled in school or being homeschooled. Could Hawaii arrest them for not enrolling their children in school? That seems to be where they are living now. |
Hawaii and the FBI do not care about truancy. I guess we have to trust that they are building a strong case and getting ducks in a row. It’s so interesting and shocking. |
It is shocking. Society totally failed those poor kids. |

This is my first time reading about this case. I’m surprised I haven’t seen more coverage!
My suspicion is that the police know more than the media and they’re waiting for these two to trip up somehow OR the police are getting a tight case together to get the highest possible charges. Maybe the prosecutor’s office is telling them there isn’t enough for the charge they’re hoping for. I feel like there should at least be some child endangerment charges, but I’m not sure what the necessary elements are. Or maybe this cult investigation is going deeper than we know. At this point, I’m willing to give the authorities the benefit of the doubt that there are behind the scenes reasons we aren’t seeing an arrest at the moment. |
