Served with Summons for child custody days before planned trip

Just go and say you didn’t get the paperwork til after the trip. What’s he going to do?

If he does,.it won't look good on OP

Maybe he just doesn’t want you to have a nice international trip while he stays home. So why not just dump the kid on his door and go yourself?

Did you get a summons or a court order?

You need a lawyer to help you with this.

So what I am reading is that you want your kid’s dad to be just a child support check. Why was a formal custody and child support agreement not figured out before this point? Probably because it was better for you not to have that, right? So continue on and don’t expect support if you won’t give up custody. Can’t have it both ways.

Sweetie, this whole single-parent thing seems to be too much for you to try and manage by yourself as evidenced by this holiday travel mess which is pretty much your fault.

Get a lawyer.

Did you already get a letter form him stating his permission to travel with the kids outside the U.S.? If not, don't go. You could be arrested for parental kidnapping.

Lawyer, no trip. Don’t mess around.

Yes.

I don’t understand how filing for custody halted the CS process. I was mid CS process when my X filed for custody. The CS rolled along. There was a small adjustment after he gained an extra day a month, but the courts don’t expect children to go without CS while custody is decided.

You can’t say that if you have been served. They know the date you got the paperwork.

A lawyer can probably get the court to allow travel that was already preplanned and tickets paid for.

Drop child off and you go.

It sounds like you would be breaking the law to remove
child from the US. Either get a lawyer or drop off
child at his Dad's (and you may have to pay the ticket
to drop off child.)

People like you just live to hurl vitriol anonymously at people who often have nothing to do with whatever it is that is making you feel powerless in your life. Nobody reads comments like yours and concludes that they’re insightful, helpful or even particularly relevant.

Exactly this. Unnecessarily spiteful. How miserable does someone have to be in their own life to post this type of hateful response? Just pathetic.
