I agree with you, but liberals are almost to the point that they don't want to do anything at all about illegal immigration. Sadly, that is the direction that the country is going in. And the tea party idiots held up common sense measures years ago like forcing employers to use e-verify. |
Yes, ultimately they will. But in the meantime, local cops could be totally deprived of fed resources and intel, just because the sheriff decided to act unilaterally. |
|
I don't see what's insane about requiring federal law enforcement agents to get an order from a court in order to have someone detained. Localities have been sued for holding people pursuant to civil detainers. State courts have found that holding people pursuant to a civil detainer violates the state constitution. They've been held to be unconstitutional by federal judges.
That known liberal, Justice Scalia, wrote in the Printz case that "[t]he Federal Government may neither issue directives requiring the States to address particular problems, nor command the States' officers, or those of their political subdivisions, to administer or enforce a federal regulatory program." |
| Good for her. ICE is a bunch of thugs and should be shut down. |
I guess that's the price to pay with the feds want locals to act outside of the Constitution. |
| We don't know if it's outside the constitution or not. A court hasn't ruled yet, and DCUM isn't qualified |
Let's rewrite that sentence to be a little more accurate about who is responsible here, shall we? "In the meantime, federal agencies could choose to retaliate against local cops by depriving them of resources and intelligence, even though that choice would make citizens less safe, and even though nothing is stopping federal agencies from getting a court-ordered detainer." |
Yes they have. Several federal courts have weighed in. https://www.dhs.gov/sites/default/files/publications/14_1120_memo_secure_communities.pdf And the Supreme Court ruled long ago that the feds cannot commandeer state and local resources to fulfill its federal tasks. https://www.oyez.org/cases/1996/95-1478 |
| Send their asses back! No sense wasting tax money to house them. |
I'm a liberal and agree with this. We all don't want illegal immigration! Heck, it should be merit based. For those that just want to do cleaning, yard work, etc. give them a work visa for just that. If they want to become a US citizen, get in line, but FFS let us know you're here. And quit just deporting people who are hardworking and honest, good folks. |
Correct. But I question whether those Fed resources are worth very much. Kincaid is the Sheriff; she manages the jail, court security, inmate transport and some extradition, and civil process and civil enforcement. The Fed money came with many strings attached, the Sheriff didn't receive all that much of it, and the Federally-supported programs had to be available for Federal direction and control. My bet is that it's a wash. |
This. I’m liberal, and in general I don’t have a problem with FFX detaining people for a reasonable anount of time for ICE— 48 hours for example (not indefinite). It’s how long the feds can detain before a PC hearing. But the ICE overreach in FFX Co is not acceptable. I do not want ICE in my kids schools, in hospitals, places of worship, and other such places. And if MS-13 is such a menace in FFX County, why isn’t ICE targeting them specifically? Why profile people at 7-11? Fuck Trump and Fuck ICE. Someone needs to push back. Under the constitution, local law enforcement has zero obligation to cooperate. If ICE is going to push the boundaries of what is acceptable, I’m glad my community is pushing back. |
I was the person who wrote the comment you responded to. I actually got to meet the Sheriff at an event last night. And she gave an excellent speech about why she is pushing back. I am proud to support her. |
| Unfunded mandate. Ya gotta pay the piper, Jeff Sessions. |
| This was a lawsuit waiting to happen. |
