| Talk to the parents and see if they will do a formal court guardianship so you can put the child on your health insurance. Or, even an informal one depending on your insurance or you need their bc, ss card, health insurance information and some kind of POA/letter so you can get everything done. |
| You’d better make sure you have the real story OP. Don’t be a sucker. |
You are solid people. Respect! |
|
Why wouldn't you, OP??
Drugs?? |
You misunderstand me. It’s generally not possible in a court of law to become emancipated without financial means. |
To wit: Necessary Findings for Child Emancipation Emancipation may be declared following the hearing if: (1) the minor has entered into a valid marriage (whether or not it has been dissolved since); (2) the minor is on active duty in the U.S. armed service; or (3) the minor willingly lives separately and apart from his/her parents or guardian, with the consent of the parents or guardian, and is capable of supporting himself/herself and completely managing his/her own financial affairs.” https://www.novaestatelawyers.com/child-emancipation-in-virginia/ |

I wouldn’t worry about legal ramifications of you housing him because legally you can’t kick out your minor child. They are in the wrong.
Good for you for doing what you’re doing though OP. I would figure out how you’re going to manage things like paying for extra curriculars, what happens if you go out of town for the weekend as a family? Do you take the other child? Etc….. |
| Look, the bottom line is that the kid is a minor. That means his parent has legal custody. You need to make sure the parent really and truly threw him out. Gay or straight. |
| You need to contact your school district and talk to the homeless liaison. You need to get him classified as a homeless teen so he can get services and benefits without relying on his parents when he graduates high school. It has to be documented that he was homeless in high school (even though he is in your house he would still be classified as homeless). |
This isn’t insurmountable. OP could charge a nominal rent amount, like $100 that can be paid from a part-time job. It’s worth pursuing for the child to pursue better financial aid options if college is where they want to go post-grad. |
The FAFSA has a dependency override without having to go to court to be an emancipated minor. The question is: At any time on or after July 1, 2022, were you determined to be an unaccompanied youth who was homeless or were self-supporting and at risk of being homeless, as determined by (a) your high school or district homeless liaison, (b) the director of an emergency shelter or transitional housing program funded by the U.S. Department of Housing and Urban Development, or (c) the director of a runaway or homeless youth basic center or transitional living program?** That is why OP needs to contact his school so he can be declared an unaccompanied youth who is homeless. Couch surfing at OP's place is considered being homeless. |
This is really good information. Thank you for posting. |

I'd wonder if the real reason he was kicked out was being gay, or whether there's more to the story and talk to your daughter to see what she divulges, then go from there. Hard to imagine a kid being kicked out for coming out alone.
I'd also consider this might be short lived. Maybe, hopefully, he and his parents will reconcile soon. |

I had a friend in HS who emancipated her senior year due to sexual abuse in the home.
Our HS counselor guided her through the entire process, including financial aid. She got a full ride at UC Berkeley. Get officials involved, OP. And thank you for doing this. |
Meanwhile, in civilized Maryland, an abused minor can sue for emancipation. https://legalbeagle.com/8736452-emancipated-maryland.html |
