The fact that the racism was targeted at Asians is merely context. Policies with the underlying intent of racial discrimination against any group should be unlawful. Affirmative Action is a racist policy and should be abolished immediately to prevent ongoing harm. |

| Justice Roberts very recently criticized how the "conservatives" are using the shadow docket. And has sided with the liberals 7/9 times recently on 5-4 decisions. Does this mean he is likely to not grant the coalition the stay they are seeking? Or if he refers it to the full court to vote, perhaps will side with the liberals as well? Does anyone know Barretts and Kavanaugh's stance on affirmative action? |
Actually, conservatives have been doing their best for quite a while to make sure it's not. Will be funny (not really, just another in the long run of hyper-hypocritical decisions) if they rely on a disparate impact theory to invalidate school policies. Fortunately, Fairfax is wealthy enough to hire good enough lawyers to achieve their policy goals without making it so obvious in the future. (You know, like the GOP tries to do with all tis gerrymandering.) |

Yes, he has because the GOP has packed the court with fringe radicals that are pushing policy that is out of touch with most Americans. He could previously side with the regressive right without fear of these laws being enacted but the Trump appointees the extremists have a supermajority. He has to draw the line otherwise they'll lose legitimacy in the eyes of most people. |
The conservative wing of the court embracing a disparate impact claim would have liberals everywhere cheering (and racing to court houses). Most of theories of liability for housing, education, and work force discrimination involve disparate impact which is heavily disfavored by conservative courts including this Court. |
