I'm guessing not, because, I guess, it's different when a Republican does it, I'm sure.

Playing to the rubes, another case of trying to make something that happens frequently, for justifiable reasons sound "outrageous" and belittling. David McIntosh of the Federalist Society should know better, his boss Leonard Leo makes a living off this nonsense (both providing outside counsel and throwing sand in the gears and dust in the eyes).

Where are you seeing that state constitutional law was his specialty?

I don't think it is strange to hire outside counsel. I am assuming that outside counsel wrote the brief. According to one analysis, its defense of the wording of the referendum fails to defend the "restore fairness" part. Doesn't sound like that is dollars well spent.

I have not seen the brief, however.

No one was confused by the “restore fairness” language. Except maybe the people who think “fair” means Republican domination no matter what because Jeebus said so.

Judges are supposed to use the law in their judgements. Not politics.
