They can do this and it would be smart to some degree. I can't believe they have the money set yet. Just not enough time. And remember this is going to have to be approved by DeSantis -- he controls the board. No way he approves if there is any chance the State is on the hook for anything. So that takes time. It will also give them more time to think about the GOR. But if I am the president of one of the other schools, I am telling FSU --- you can give notice in a year but if you block expansion and then give notice -- do not expect any break from the rest of us. You will pay full freight, whatever that turns out to be. I think the cost goes up, not down if they wait. But of course if not ready then they have no choice. |
With an issue like this when that person says least of his worries that means it is a big problem. If they thought they had a solution the comment would have been --- it is a private matter and we will discuss with the other schools. What he is selling is spin. |

I do not know enough to offer any specific insight. I would like to read the Notre Dame ACC agreement to look for any inconsistencies with the GOR document signed by FSU because the GOR document shared in this thread has a provision regarding all future members. So many legal theories to consider. Best to leave it to the lawyers who have been working on this full time for months. |

Does anyone have an opinion regarding the costs of exiting the ACC agreement to be excessive to the point of being unconscionable, unjust enrichment, or any other legal theory.
What is the point of a $120 to $130 million dollar exit fee if the school leaves behind almost all of its assets until 2036 ? I have not thought about this much as I was hoping for notice by FSU to the ACC followed by particular claims by FSU. |
I think a multi-billion dollar organization who was represented by counsel in the deal really could not claim they got the raw side of the deal. The exit fee is its own thing that was willingly agreed to. But you are wrong about the GOR. They do not leave the assets behind. The media rights go to the ACC but the ACC makes a payout to the departing school every year. They still get their ACC share. It's not like they get no money. They get the lower ACC share instead of the SEC share. The SEC share goes to the ACC. |

I guess how would an agreement with a different party about a different subject have any bearing on the GOR? Read the GOR. It was designed for what is happening right now. Really tough to get away from it. That is why FSU will not do anything tomorrow. They are flat stuck. |
ND cannot join any other conference but the ACC until 2036. So they can stay independent but join another conference. Not sure what the penalty is. |

Obvious & appropriate questions. I would like to know more. I would like to see contracts from other conferences. I would like to know about authorization under Florida to contract. I would like to know a lot more. And I do not know what I might find or if it could be used. My point is that I do not know enough specifics to offer answers, but I do know enough to ask questions & seek out information. |
The GoR is different. Even if a member could join, they no longer own the right to broadcast their own home football games. For example, if the Big10 decides to take FSU, then ESPN can still broadcast Ohio State at FSU thanks the the GoR. Realistically, no conference will touch them until litigation is over and FSU doesn't have the alumni wealth or the endowment to sustain an independent athletics department with no television revenue which its in the courts. I'm sure FSU is terrified that by the time the GoR expires, they will be behind both Florida and UCF and an after thought. If they could have gotten out, they would have years ago. The same applies to Clemson. They do this same song and dance every year |
Clemson hasn’t been vocal or frantic like FSU. FSU is looking stupid for signing the GOR…. Frantic and undignified under pressure… and untrustworthy towards its partners. I used to think they were B1G ten material but no more. They are poison. |
