Carlos De Oliveira transmitted the message from Trump to the employee who was asked to delete the tapes. If he does not flip and testify, he could go to jail and Trump would be safe because what the employee heard regarding Trump's wishes is hearsay.

He doesn't actually have to be in court except if he chooses to testify.
