There is often more than one court that has jurisdiction over the parties, so the plaintiff can chose among them. Similarly, when a judge is deciding what law to apply, because there is often more than one state’s laws that can be applied, one factor to be considered is where the plaintiff chose to file. It would have strengthened Blake’s argument that CA law should be applied if she filed her lawsuit there instead of NY. |

Alex Saks was a producer on the film. She was hired directly by Baldoni but she also worked with Sony a lot (specifically Ange Gianetti at Sony who was Sony's major "creative" on the film). She was on set almost every day of filming and present for many of the critical meetings including the Jan. 4 meeting. However she was not present for many of the alleged moments of SH. She had close relationships with not only Justin and Jamey but also Blake, Jenny Slate (this turns out to be very important), and many of the production heads on the movie (like people who headed up different departments like set design or costuming). I have to say have reading her deposition, I still don't know if Blake was SHed or retaliated against BUT it leaves me with an extremely low opinion of Justin and Jamey. What Saks describes of her own observations of their behavior is really bad. It actually kind of gave me flashbacks to the worst job I've ever had. She describes Justin, in particular, as a narcissist. She describes multiple occasions when he yelled at her in work meetings, and one where he yelled at her on set while banging his hands on a chair next to her that she said made her feel physically unsafe (she says she told other producers that if something like that happened again, she would walk off the film). She also describes Jenny Slate coming to her and expressing major concerns about Justin and Jamey, concerns that were so strong that she reached out to Ange Gianetti at Sony to say that she thought Justin needed to be replaced as director and that Jamey needed to be removed from the set. Saks says that Jenny Slate told her she would be happy to never see Jamey ever again. This was all *before* Saks was even made aware of any of the stuff Blake later alleged against Justin or Jamey. It sounds like Saks had major issues with Justin and Jamey before production even started, and that the reason Saks' first started raising questions with Wayfarer about potential HR violations or problems, was all based on what Jenny told her, not Blake. Also Saks says that when she repeatedly suggested that Wayfarer conduct an HR investigation into what had happened with Jenny, Jamey ultimately shut it down because he didn't want there to be a record of any of it. Saks also explains that she fully supported the decision to fire July Bloom as 1st AD because, according to Saks, the combination of the very "green" Wayfarer team and Bloom, who was coming from TV and didn't have a good handle on the level of communication and other requirements for a good film AD. Saks describes the set prior to the strike as being extremely disorganized and unpleasant to work on, and blames Justin and Jamey for this. Saks also says she fully supported Blake getting the PGA mark and felt Blake's work on the film merited the credit. I don't know, this is starting to look very bad for Wayfarer. It was kind of startling to see it laid out like that. I think if Jenny and Isabelle Ferrer's depositions are similar, this just becomes very ugly for Justin and Jamey. You can say what you want about Blake having her own issues, but when this many women on the set of a move just HATE the two men running it, you have to start asking if maybe the problem isn't the female star but actually with the two dude everyone can't stand and complains about. |

She was on the set nearly every day but was not physically present for specific incidents because they occurred in parts of the set where Alex was not present. A film set is a large, sprawling village of people. It's not like one room. A producer is frequently in meetings, especially with department heads, or may be on the phone a lot. It is not surprising that any one individual on the set might not witness a conversation that occurred during a lunch break, or inside someone's trailer, or among actors right before or after a scene filmed. And the point is that it's clear Alex saw quite a lot, actually, including incidents involving Justin or Jamey that she believed made people uncomfortable and raised concerns for her about the HR oversight of the set. These included: - Justin repeatedly asking department heads to join him at a Russian bath, until Alex told Jamey that it was inappropriate and Justin needed to stop - Justin and Jamey both joking that they couldn't even look people in the eye without getting called out by HR, which Alex said was likely to make people on the set feel uncomfortable raising concerns - Justin shouting at Alex and slamming a directors chair to the ground of a minor disagreement regarding whether or not they had gotten sufficient takes of a scene they were shooting - Jamey refusing to investigate Jenny Slate's HR concerns out of concern about having these incidents written down or memorialized in any way These are very concerning behaviors. It is very clear that Alex Saks and others on set found Justin and Jamey to be unprofessionally and boundary violating in a variety of ways. All of which is quite bad for their defense that they did nothing wrong and this was all blown out of proportion by Blake and only Blake. |
It's clear from Alex's deposition that she and Jenny developed a good working relationship on the set. Also potentially that they bonded over different negative experiences with Justin and Jamey. It sounds like Blake and Brendon got along well on set and really liked each other. Blake has a long history with Feig who speaks very well of her, it makes sense that she might recommend a costar she really liked to Feig and that Feng would take her up on the recommendation given his affinity for Blake. Also Sklenar is a rising star in general so it makes sense he would be offered more jobs. It sounds like Ryan/Blake and Liz Plank knew each other before Lively was even cast in IEWU, and that Plank may even have been the part of how Blake became interested in the project or hooked up with Wayfarer. So it would make sense that Ryan and Blake would continue to have a relationship with Plank afterwards because none of Blake's negative experiences on the movie involved Plank. It also sounds like Plank may also have experienced negative things with Baldoni and Heath. Also Hollywood is an industry run almost entirely on connections. This makes sense given that most of Hollywood is just a series of productions that end. Everyone is always looking for a new project. So if you work with someone on one project, it behooves you to nurture that relationship in the hopes that it might lead to more work. Because everyone is always just a few months away from unemployed. |
She was on set and saw things that made her uncomfortable but she as the producer is not involved in every conversation on set. She didn't even recall the conversations she was involved in! So when Jenny Slate came to her, she hadn't witnessed those conversations but she had already reported concerns to SONY. Being on set doesn't mean you are part of all conversations. |
I will believe she was part of the set up. There is an email from her or I believe it was a text telling Justin not to back down and give Blake the dailies. Then she turns around and says he’s uncooperative sorry but you are really missing a lot in the interactions with Alex and Cherry picking the ones that look good for Blake. |

DP but I think you are cherry picking. So neither Justin nor Alex thought Blake should get access to all the dailies -- there are a variety of reasons Alex might have agreed with Justin on that which have nothing to do with Alex's opinion of either of them. For all we know Alex just generally opposes giving actors full access to dailies. But if you read her deposition, there were many incidents both before that email and after in which Alex expressed deep concerns about Justin's and Jamey's behavior on set. Including an exchange with Ange Gianetti in June 2023 where Alex says she believes Justin needs to be removed as director and and that Jamey should be removed from the set because the problems are so bad. She also testified in her deposition to having three separate conversations with Jamey (one of which involved Justin) about Jenny Slate's HR concerns and strongly advised them to conduct an HR investigation into her concerns, but that Jamey ultimately decided against it because he didn't want there to be a paper record. There are also multiple texts/emails where she expresses a strong desire to use Sony's HR procedures on the set because it is not clear to her that Wayfarer even has procedures and she was already concerned (before shooting had even begun) that this might become an issue. This is a huge red flag! They hadn't had a day of filming and the one non-Wayfarer producer on set (with 10 years of Hollywood experience including on large productions with A-list talent) was expressing concerns about HR. Ask yourself why. |

Alex also said a lot of bad things about Blake, “warning” WF multiple times in texts that Blake was trying t take over the film. . She clearly tried to play both sides, and would be an easily impeachable witnesss by either side. It doesn’t look bad for Wayfarer because this is just people who didn’t like each other, not sexual harassment. |
