He admits on the recording that he has classified documents in his possession that he didn’t declassify and are still classified. The Justice Department has to prove that Trump knowingly retained these documents even after he was ordered to return them. This recording is an admission that he’s doing just that.

Yes, of course, if it hasn’t been declassified. Even if the route is old news there could be agent names, phone numbers, operational details, etc. in the document that should be redacted.


The standard is beyond a reasonable doubt. So if I’m on a jury, ‘could be’ doesn’t count. Ditto if prosecution shows a heavily redacted document they claim is the same on in an audio tape. I have no idea if it’s the same one or not.


There were other people in the room. They will be called to testify about what was going on in the room at the time. They undoubtedly already have testified to the GJ.

I enjoy juvenile insults as much as the next person, but the point is, no, not a one of these Trumpets has bothered to read the indictment. On the one hand, I get it. Legalese is usually pretty dull and for us non lawyers it can be pretty opaque, but that’s not why they’re not reading it. They’re not reading it so that they can continue to believe the lies they like. It’s the same reason they don’t read the stories about women dying for want of a simple and safe abortion. It’s the same reason they don’t actually ever listen to or watch anything that would confirm that global warming is real, serious and caused by us.
