How can Elon place people on admin leave?

I’m sorry in advance that I don’t understand this better.

Musky is not a federal employee and is telling people they can’t work if they don’t say yes to all his commands.

How is it so simple?

And how are Elon’s boy programmers able to work with highly classified information?

My understanding is one of the boys is a Canadian, but I’m not sure.

I had to go through a whole background check before I could access classified info so it really boggles my mind that a drug-addicted billionaire with ties to China can read through all this classified info and also basically fire people.

I read the recent OPM rule making on admin leave. Admin leave is set out in statute and O regulation - but both make clear that it is the agency that makes the decision, NOT OPM. So no, OPM has zero legal authority to place people on admin leave (other than OPM employees). In addition OPM is not the employer - the individual agency is. So only the agency can make a legal agreement with the individual worker.

Besides these rather large issues, it’s not at all clear that agencies have *any* authority to place people on admin leave as part of a “deferred resignation” package.

In some cases, I know those at the top resigned or were placed on admin leave because they would not do it. But isn't he getting to a pretty low level employee who would not be able to make those decsions.

Since society is lawless, why don't we kick Trump to the curb? No laws, right? My logic is crazy on purpose to reflect their "logic."

Why do presidents need security? Let's just get rid of it if we're not going to have laws any longer.

He is doing the president’s bidding and the president is head of the executive branch. Musk can do all of this and more—there is pressure from him, downwards, and the folks who do have the authority do what he says or they go.

This is extreme for sure, but it is always how things have worked when a new president comes in. It’s just not ever been this fast.

yes it is. the fork emails come from OPM and persistently claim that OPM has authority it DOES NOT have. of course there is a way to legally design a RIF, VSIP or VERA but that is NOT what is happening. And none of this even constitutes a clear executive order or other sort of directive to agency heads. It is pure extra-legal chaos.
