If you go back to the beginning of the thread, I think people were speculating that it might have still been in the road when he hit it and that would be a reason to call? That way they can move it out of the way. |
My father is a retired lawyer. He represented a man who hit and killed a pedestrian; the driver thought he hit a deer. It was 5am, pitch black, and he didn’t see what he hit. He pulled over, walked around, but couldn’t see anything. Turns out the man was dressed all in black and walking in the road.
He got off. He truly believed he hit a deer, and the victim was negligent for walking in a dark road dressed in black. I think he lost his license for a while. No jail time. Happened in the early 90s. Nobody famous involved. |
In Virginia it's a Class 3 misdemeanor to hit an animal and not report it or render aid. Also damage more than $1000 to your vehicle on a public road is supposed to be reported. Not doing so is a Class 5 felony. Did you ever take a class to receive your license? |

There has to be a will to do a proper investigation but you are thinking correctly. That should have been done the first day of the “investigation.” The family of the deceased should sue. AGs insurance company would at least investigate but they have a financial motive to find no fault on the part of the AG. |
