I couldn't believe this story was true but it is! This guy didn't even say he was Jewish. He just had a Jewish nickname and he didn't say he was Arab. They had consensual sex. She found out he was Arab so now he is in jail for 18 months for rape.

Wow. Whatever you want to say about the state of human rights in the United States (and you can say a lot), we would never send someone to jail for not disclosing their ethnicity in a sexual encounter. That's really creepy.

The crime appears to be 'rape by deception'. Personally, I think it is fairly unsavory to misrepresent yourself in ANY way and have sex with someone under that representation. I also think people should do their research before having sex with someone. Sounds like he was unethical and she did not exercise due diligence. I don't see the long-term harm though (as opposed to someone not disclosing an STD) so overall, sounds like a frivolous case.

"Sabbar Kashur, 30, was sentenced to 18 months behind bars on Monday as part of a plea bargain for "rape by deception."

Kashur first met the woman in downtown Jerusalem in September 2008. Kashur, an Arab from East Jerusalem said he was a Jewish bachelor looking for a long-term relationship. The couple went to a nearby building and had consensual sex, according to the complaint."

Think about all the guys you've slept with, especially when you were young and hanging out in bars in Georgetown, the ones th at said they were on the partnership track but only did document review JAIL, the ones that worked in commercial real estate finance but were really gophers JAIL, the guys who claimed to have a trust fund but were on student loans JAIL, etc etc

This is *exactly* the same thing as two folks meeting in a bar, going home and having sex, then one of the two finding out their partner is mixed race.

Would you think rape charges were perfectly acceptable then?

The argument here is the woman wouldn't have consented to the sex if she knew the guy was Arab. Fine. Whatever floats her boat. The fact is, she DID consent. You can't rescind consent after the fact. The worst he is guilty of is fraud. And given that he didn't actually lie, he simply has a Jewish nickname and didn't advertise that he is Arab, no fraud was committed. This woman shouldn't have jumped to the conclusions that she did if the ethnicity/religion of partner was that important to her.

The claimed deception was not just of his ethnicity but that he told her he was single when he was actually married. That is the "deception" for which he was convicted.

Would he still have been convicted if he was an israeli married man, rather than a palestinian? Maybe not, but he did commit a crime.

Human Rights in the US are so bad? Is that why all those people are risking their lives in the AZ desert to get here? Gimme a break.

I have several responses:

It would be a bit easier to discuss this if they translated the offense as "sexual fraud" rather than "rape".

The judge said the woman thought the guy was a Jewish bachelor, but it's the fact that he's not Jewish that got him convicted, not the fact that he's married!

Finally, I think the headline should have been Kashur Ain't Kosher.

Please reread more carefully. My point was that the protection of human rights in the United States is not what it should be but it is far better than what happens in Israel. And I imagine it is far better than what occurs in the homelands of the people risking their lives in the desert. But the United States still has a ways to go and we're not where we should be. Despite that, we have much to be proud of -- in particular that we don't allow foolish racists to turn a stupid one night stand into a matter of rape because of someone's ethnicity.

This reminds me of an incident many years ago when I was crossing the border from Jordan into the West Bank with a group of Jewish Americans and Palestinian Americans. One Palestinian-American woman was strip searched (didn't happen to the non-Arabs) and the border guards tried to confiscate the soap in her suitcase that she was carrying as a gift for someone. Our Jewish American tour guide told the guards that the soap was his and that the Palestinian-American woman was carrying it in her suitcase for him because he didn't have enough room in his. They allowed the soap to pass. The lesson I learned from that -- in Israel, Jewish soap is clean but Palestinian soap is dirty. And I think that's the lesson this deceived woman wanted us to learn -- if a Palestinian doesn't reveal his identity, then it's rape. But I'm guessing that she doesn't call the cops when a Jewish guy lies about being a doctor.

In the United States, we at least try to live by the ideal that racial/ethnic groups should be treated fairly and equally. We don't live up to it anywhere near as much as we should but I'm proud of the fact that we hold that as an ideal.
