He claimed during his sentencing statement that his parents did not know he took the car. I believe this eliminates their exposure and I'm sure Greenspun advised him to make this statement under oath for that purpose.

It does not. The car has to be registered in the name of someone with insurance. That can’t be Shahid since he didn’t have a license. His parents will be party to the civil lawsuit.

At 18, he could have had his own car insurance in his own name, since he had a license with restrictions. Or it could have been his parent's car insurance.

This has been explained before on this thread. Permits in VA are not “licenses with restrictions”. They are a permit only.

In Virginia, you can register a car and get car insurance for your car when you have a "permit only" or a license with restrictions.

Fwiw, a regular driver's license is a license with restrictions, it does not permit you to drive a commercial vehicle or a motorcycle. You need a separate or additional license for that.

Learner’s permits are not “licenses with restrictions” in VA. https://www.dmv.virginia.gov/licenses-ids/learners/apply

Jury recommended four years, two per each count. Final verdict in July.

Outrageously short sentence.

Judge can't increase the sentence. I had thought 4-8 years seemed likely. This is one the low end and, unfortunately, doesn't really penalize Shahid for refusing to plead guilty and take responsibility. Given that it took several hours for the jury to reach a verdict, it's reasonable to assume there were some sympathetic jurors.

Okay. You can get car insurance with a learner's permit for a car, especially if you are 18. I don't know whether he had his own car insurance or was on his parent's insurance.

You can’t get car insurance without a drivers license.

Anonymous wrote:Well he was an adult. Did he pay cash for the car and who was on the title to the car? Under whose name was his car insurance? He was with 2 friends during the crash. How old were these kids? I'm sure his parents let him take the BMW since it was his shiny new toy and he wanted to show it off.

Adults aren’t allowed on car titles if they’re not licensed.

Whether a learner's permit is a permit or a license, you can get car insurance with it. Actually, you must have car insurance with a learner's permit if you drive a vehicle (or pay the uninsured motorist fee).
