I'll be listening. But what's the point of having a rally? The money and time is better spent supporting women who won't be able to get the health care they need when these religious radicals overturn a 50-year-old Supreme Court precedent. |
This will be more palatable to SCOTUS.
Roberts will be eager to engineer a compromise of some sort - maybe a Casey-plus. Texas, I suspect, the Court is terrified of how this tactic will be used, and may be trying to write an opinion that slams the door on this tactic being used by ANYONE, say Illinois or Massachusetts to further liberal pet causes or other conservative states pulling a Texas. Texas goes beyond just abortion. It goes into the very fabric of the relationship between citizens and the State. |
Rallies bring attention to the issue, and demonstrates that people in this country care enough abortion rights that will come out for hours in freezing whether to rally in support of them. For people in power who are inclined to follow their political winds more than their own convictions, those things matter. |
Rallies outside remind those inside that their rulings are absolutely worthless without the trust and consent of the people outside. The Supreme Court has no enforcement authority outside of the Marshalls service, and good luck getting them to patrol abortion clinics in New York or Massachusetts for people to haul in for contempt. If the majority of the people view a SCOTUS ruling to be illegitimate, which the majority will if RvW is overturned, it won’t be followed because no one will enforce it. Period. Republicans have been crapping on the rule of law for a long time now and have done all they can to make the courts a tool of the right. Roberts knows the credibility of his court is hinging on a thread. The other right wingers don’t care because they take for granted that people left wing and center trust the court. I don’t think they’ve taken into account what will happen if they lose that trust. |
Except it will be enforced - at least 12 states have laws on the books making abortion illegal as soon as Roe is overturned. This is just another tool to divide our country further. |
Enforce what? As far as I know, striking down Roe v Wade returns the legislation of abortion to the states. It doesn’t make abortion legal or illegal. Some states will restrict it further, some states will expand it. Some states will leave it as is. Is my interpretation of this wrong? If so I apologize. |
Justice Sotomayor: 15 Justices in the past 30 years have reaffirmed the holdings in Roe and Casey. Will this institution survive the "stench" that we'll just be seen as "political hacks" if we now overrule these holdings after 3 new Justices have been put on the Court? |

So the Mississippi AG is arguing that the entire Right to Privacy doctrine should be overturned. Justice Handmaid tried to bail him out, but he doubled down. |
Yeah I loved the part where he thinks jurisdiction over this issue should return to state and local control. The most local control is the woman who has the uterus in question. |
