Last week I was off two days. One day I called out, and one day DB told me not to come in. Sunday db messaged me asking how I was feeling. I told him I was on the mend. He asked when the last time I threw up. I said that morning, but I was feeling better. He told me not to come in. I said thank you and that was that.
Today I come in and I noticed after they left 2 days have been deducted. I am out of sick days, because of an emergency hospital stay. I didn't/do not expect to be paid for the day I called out. I need a diplomatic way to bring this up. If like to remain |

While I usually go with "they told you not to come in, so they should pay," in this case, you were still throwing up that morning. You can't go to work contagious and throwing up. It sucks that you're out of sick leave, but maybe you can use vacation leave? That's what the rest of us have to do in these cases.

I should add I didn't mind coming in because the whole house was sick. I spent half of the week scrubbing the babies vomit out of the carpet. Then the 6 yr old got strep. Nk told me she had strep when I got to work. Db took off because he was sick, that was Monday. On Friday j was sick and still came to work. Mb was sick and throwing up, so she stayed in bed all day.
If the entire family was well I would have called off. |

| Then they should pay you. You need to address this directly. There is probably no way to do this without causing at least a little defensiveness, but taking the one day unpaid should help mitigate that. |

That's my feeling. I have taken unpaid days off before. I didn't have an issue. When db asked how I felt I told him Lousy, but is still be coming in. I told him I knew mb needed me so she could cook for Seder. He told me that I " need another day " Thanks for the advice Everyone |

I can see both sides of this, especially since they were home. They probably thought they were doing you a favor by giving you another day off, and didn't want to infect any guests that might be coming in. At the same time, you were out of sick leave, and that left you with a day without pay.
It sounds like there's more going on here, though, and I wonder if there's just some fatigue on everyone's part in terms of deciding what's right and fair in terms of an illness policy. You were out for an extended period for an emergency at one point, but you have also taken "unpaid days off" in addition, and the job ends in a few months. |

I agree. My illness has left me with a weaker auto immune disease. Which I've been upfront about. They have all been sick a lot this year. I took an extra day or 2 ( I don't remember) when I was in the hospital. This is the first time since the first week of January. As far as what's right and fair I have never asked to be paid outside of my vacation days for the few yrs I've been with them. I would have taken it out of vacation, but they decided our 2 weeks without discussing it with me. I didn't argue over it because I'm leaving soon. |
| The time to negotiate pay for the second sick day was when you were texting with your boss. He thought you were too sick to come in, you said thank you, which I would interpret as agreement. You could have said "if I don't get sick again before the morning then I will come in since I am out of paid sick days." |

24 hours is just a policy, a person can still be contagious for up to a week. I was told by the pediatrician that 48 hours was a good standard, meaning going back to work 24 hours after vomiting very well could be too soon. |
