The family I work for just fired me and I think it's because they found out I had an abortion last week. Now I know that nannies are at will employees and can be fired for any reason, but should I consider hiring a lawyer and trying to sue them for this? I have just had a wonderful yearly review from them and then they fire me without notice and they didn't give me a valid reason. Do I have a case? Is there anything I can do? I'm also almost positive the way they found out was by going through my purse. Any advice is appreciated. Thanks. |

Ouch. I don't think you're going to be significantly helped by the responses here (judging by PP) Op. I'm sorry - sounds like you're having an epically tough June.
I don't really see how you could prove the ground or sue successfully. No lawyer is likely to see enough potential in a case like this to make it worth their while and you're unlikely to have the resources (or possibly will) to sustain a long nasty fight. Did they not give you a reason for the action? Did you ask? Did they give you any severance and do you have any contractual language about termination/severance that can help you? |
OP, the answer to your question depends on if you have a contract and what it says. It's shocking that the "lawyer" PP didn't say the truth.
If your contract has a term (end date) which is in the future, you can sue them for "wrongful termination". Since you're essentially unemployed now, you can get free legal aid. Are you in the DC area? |
May I ask what you told them you were doing when you got an abortion? It takes a toll on the body physically and emotionally, so I'm assuming you requested time off? Maybe they thought you lied about being out?
If you have no contract you might be out of luck. What reason did they give you? |
I honestly hope you're not suggesting OP should have told them her personal affairs, are you? Unless her contract says, "at will", she has a solid case against the parents. |
I can't imagine on what grounds you could sue. You can be fired for no reason and there is no legal entitlement to notice. If you apply for unemployment and they claim that you were fired for cause you can appeal. The family would need to state what the cause action was for you to be denied unemployment. |
I think there is more to this story you are telling us. Did your employer regularly go through your purse before this? Did you take time off of work, and if you did, did you schedule it beforehand, or call in without notice?
