I think there is a big difference between a nanny who cares for your child every day and someone who cleans your house every few weeks.

In the government's opinion, there isn't. Both are domestic employees, both must be legally residing in the US, both must be legal to work in the US, and you must pay legally for both. Your nanny cannot be listed as a contractor; most housekeepers can't be listed as a contractor either.

You are confusing tax obligations with the requirement to list someone as a foreign contact on a SF86. You only list someone as a foreign contact if you have had close and continuing contact with that person and are bound by affection, influence, or obligation. A nanny likely would fall under this category. A house cleaner would not.

A house cleaner who comes once every two weeks isn't a domestic employee, she's a contractor.

No there isn't. You have to report everyone who is not in the US legally or you risk losing your clearance. We have relatives another country and we have to report even Skype phone calls.

No there isn't. You have to report everyone who is not in the US legally or you risk losing your clearance. We have relatives another country and we have to report even Skype phone calls.


You have to report close and continuous contacts with non-US citizens. It has absolutely nothing to do with whether they are in the US legally. There are plenty of non-US citizens who are in the US legally (like those with green cards). You report them if you have close and continous contacts.

Is she allowed to come and go as she pleases or does she come at a time you set?

Can she find a replacement if she can't make it or do you find a replacement/do without?

Does she provide all chemicals and tools necessary to the job or does she use what you have?

If all 3 of the answers are the first, she's a contractor. If any of the answers are the second, she's an employee, per Dept. of Labor and IRS.

You need to employ your housecleaner legally as well!!

I'm the poster with the TS clearance above. Not only did I officially document my housecleaner's legal status, but I also pay taxes and have a workers comp policy for my housecleaner

Your housecleaner is only a contractor if s/he is hired through a maid service. So if your check goes to "Maid Brigade" (which substitutes their staff at their will), that's a contractor.

If it goes to a person, that's an employee.
