[/quote] In the government's opinion, there isn't. Both are domestic employees, both must be legally residing in the US, both must be legal to work in the US, and you must pay legally for both. Your nanny cannot be listed as a contractor; most housekeepers can't be listed as a contractor either.[/quote] You are confusing tax obligations with the requirement to list someone as a foreign contact on a SF86. You only list someone as a foreign contact if you have had close and continuing contact with that person and are bound by affection, influence, or obligation. A nanny likely would fall under this category. A house cleaner would not. [/quote]
