Can you explain that for non-lawyers?

SCOTUS directed her to specify what she wanted DOJ to do specifically - order said to outline terms for “effectuate.” She still hasn’t said that. Is she demanding Trump provide evidence that he has asked ES for example? DOJ is saying you still need to explain this and she is evading and proceeding to discovery while throwing out contempt trial balloons. It’s a dance she will lose.

What argument? Xinis is setting up contempt charges. Which the government deserves, since they are not bothering to bring him back, as they have been ordered.


Who cares? We all know she is. There is no way for her to enforce anything because she doesn’t control the DOJ.

This is all going back to SCOTUS once she outlines what expects the government to do, and they appeal claiming it’s an encroachment on article 11 powers. It ends there. SCOTUS isn’t going to dictate foreign relations. At most she gets a PR boost on the left but this issue as a whole isn’t helping the left.


I know of an instance when DOJ was sanctioned for $$$. It has happened before. It may happen here.

The Supreme Court said that the District Court order is in effect with one clarification. The court order asks for daily status updates addressing 3 bullet points. So far, they haven't provided those, in spirit or letter.

Just fix the mistake. That's all.

This isn't an Article II issue. It's a contempt issue and disobeying a court order. Everyone knows this.

He was here legally under TPS status granted in 2019 when Trump was president.

So the deportation wasnt an error -- it was simply where he was sent. That is a big difference.

He went before an immigration judge in 2019 and was told he cannot be deported to Salvador based on the danger to his life in that country. So if he was to be deported, that was the one country, he was not supposed to be deported to.

So while he is not a US citizen and is yes, a citizen of El Salvador, he was in our country due to the danger to his life. And should not have been deported to that country.

Why shouldn't he be allowed to get due process which is part of the constitution! Remember that document? that is the biggest issue here he should've been given due process. He was snatched off the streets w/out an arrest warrant and then just sent to the one country he was not supposed to be sent to.

Yes, he may have been in danger in 2019. So it is perfectly valid to evaluate if he is in danger in 2025. Many of the gang members threatening him may be in CECOT.
