Both Jones and Lively have represented to the Court that they properly obtained the texts via subpoena but that is untrue because the subpoena issued in sham litigation. The litigation was a sham because VanZan pled a breach of contract claim, which isn’t amenable to Doe litigation because counterparties are known. Furthermore Van Zan had no relationship, contractual or otherwise, with the Wayfarer defendants.

Jones also represented that the subpoena was Court ordered but no judge was ever assigned to the litigation.

Lively doesn't even need the subpoena to have lawfully obtained the texts. Even if Jones just gave then to her, Lively would not have committed or abetted a fraud to get them.

Jones might have violated contract, I don't know.

The fraud is misrepresenting to the court (Liman’s court) how they were obtained.

Only if the subpoena wasn't legal, which it looks like it was. What is the misrepresentation?

I agree it's kind of a dirty lawyer trick, but it doesn't look like fraud to me.

If you're referring to Jones saying the subpoena was court-ordered when it may not have been, I don't care about that case. I think Jones has done several things for which she might get in trouble or at least lose her case, but I am not really invested in the Jones case either way.

I don’t think it’s correct to say that a subpoena issued in sham litigation is legal. Looks like we’ll find out soon enough.

I think this is wishful thinking on the part of team lively. For weeks before we learned about Vanzan, her supporters on this forum insisted it was a “pre litigation subpoena”. They were loud and rude and said they were “lawyers” and the rest of us underlings simply didn’t know what we were talking about. After the Vanzan story broke they then pivoted to “well this is perfectly normal legal strategy and Freedman just got out lawyered”. Meanwhile creators talking about Vanzan had their videos muted and it was rumored that BL’s team had brought on criminal lawyers, nothing suspicious about that at all…

To be fair, pre-litigation subpoenas do exist, and can be used in cases where there is reason to believe documents or other evidence (say security camera footage) will be lost before the potential plaintiff could bring a case. It's not unreasonable to have thought that's what might have been used here. Baldoni supporters also had a bunch of theories (that there had been no subpoena at all, for instance) that turned out to be false.

That’s because neither Jones nor Lively produced the subpoena, and still haven’t, which was suspicious.

Back to pap walks I see. She better hope her lawyers won’t have to do a perp walk over that subpoena.

This looks fine? I actually generally do not like her style at all but this seems like a cute and comfortable outfit for a regular Saturday. I don't even hate the texture in the top.

Hmm..

She hasn't been deposed and it sounds unlikely she will be.

She will be, it’s the normal order to get documents from a witness and then after reviewing the documents produced, depose them.

Most people who are served subpoenas for documents or communications are never deposed. And in a civil case, if a witness is resistant to deposition and contends they have nothing relevant to contribute, you would need to be able to prove that you have reason to believe the witness has info directly relevant to the case. What Baldoni has so far produced doesn't show that -- all he has is that in one occasion Swift has told him she liked the scene Blake allegedly wrote. If that's it, there is no way Swift will be deposed -- a deposition is expensive and time consuming for the witness, and judges don't let you just haul whoever you want in to question them.

Also keep in mind Swift is a billionaire and has access to great lawyers, and if she doesn't want to be deposed, they will fight very hard to prevent it.

I don't see it happening. She is, at best, tangentially related to this case.

Disagree, I’ve never seen a witness with a documented connection to the case, via email/text here, successfully resist a deposition. Like everything else, we’ll see.

What is her documented connection to the case? What info could she offer that would be useful to either side? Be specific, and link it to one of the legal claims being made. You can't depose someone just because you think it would be interesting to ask them stuff because they are famous.

It’s not a random lazy Sunday outfit, it’s like a tacky $5,000 outfit and she prob called the paps because she delusional thought it looked casual cool mom core or something.

Is it? The Daily Mail article had a photo of the back and I think those are just Levis.

I love making fun of celeb fashion and have found MANY BL outfits ridiculous in the past (hates both the red carpet dresses she wore for recent premieres) but this looks cute. I would wear it. That purple is really flattering with her coloring and the purse is a fun detail. I have nothing to complain about here.

DP the cut and texture of the top is unflattering. The shoes are dirty. It’s fine if you’re truly just bumming around but not sure why she’d call the paparazzi to take a picture of this.

If you don't think you're looking at the product of a publicist effort, you're naive. This kind of thing is planned down to the outfit and the drink in her hand.

I'm sure she's done a million pap walks but: maybe she didn't. It just looks like a normal outfit. There's no info about where she ate lunch or who with (typical of pap walks). Given the court case, she probably does get regularly tailed by photographers, so this might be a true paparazzi photo.

I do not think the outfit is unflattering because it was clearly worn just to hang out. It's not a red carpet photo or the kind of pap walks where they clearly got styled with the intention of being photographed. Those look like her "comfy jeans" -- the pair you wear when you don't care about looking great and intend to eat more than an appetizer.

Yes, sometimes. But also sometimes celebrities leave their homes just to do normal things and get recognized and photographed.

No one is tailing anyone in nyc, sorry but no.

The people that dislike her the most are the ones creating the market for those stupid pics.

Of course paparazzi sometimes try to get photos of certain celebrities. Yes sometimes the celebrities call them and set the whole thing up, but even when they don't, sometimes the paps camp out places trying to get photos. That's how they make money.

There would be a lot of money in a photo of Blake looking bad right now, for instance. This is probably about as close as they will come because I'm sure she's aware of that and is careful not to leave the house looking terrible. But look how this photo is framed in the DM story -- it's about how dressed down and unglamorous she looks. Except it's just a normal photo and she looks fine, just not totally photo ready.

Blake would have zero reason to call paparazzi to come take a photo her in loose fitting Levis and a regular top with a coffee and paper bag in her hands. What benefit would she derive from it? She's already in the press daily, and her Another Simple Favor photos are still circulating, where she looks great with professional hair and makeup. This photo isn't bad but it's not good either.

She called them because she thought it was a nice dressed down look. She was wrong. When you’re busty, it’s best to avoid texture and high necklines, so the top was a bad choice for her. The purse was a bit too coordinated and not in a good way. She styles herself so it’s hit or miss. Her London looks for another simple favor were horrible. Her time look was nice.

She definitely called the paps, just like she did at the horse farm (when they captured her looking “sad”). NYC is extremely busy and brimming with celebrities. The paps weren’t following her or camping out waiting for her to pick up food (they knew she’d be there b/c her publicist likely told them).
