Neighbors walk around nude all the time

Anonymous
People have been arrested for being nude in their own homes when the police suspect the person knew that a child could see them -- happened in VA, but don't know the outcome of the case.

I think of you mention it to them, they will get blinds.

If your shades are open and you can be seen from the street (e.g., if the cops can see you when they walk by), that is public place. Also repeatedly exposing yourself (i.e., Flashing!) is considered an indecent act, especially in view of minors.

Your neighbors don't want to be charged with public indecency since that may require them to register as sex crime offenders, limiting their ability to work/travel, lose custody of their kids, etc. Just tell you neighbors, and they should take appropriate actions.

Regarding peeping tom laws in Virginia, it requires a trespassing (e.g., going onto someones home without their permission) or making a peep hole in a public place (a changing room, locker, bathroom, etc.). There is no trespass if you can see things from a public sidewalk.

I'm a lawyer. If they are in their house, they are not in a public place. A house has a reasonable expectation of privacy.

If anyone at my house were arrested for this, I would file civil rights claims against the police and I would litigate it to the bitter end.

If you were the neighbor who called the police about it, and you did it more than once, I would get a restraining order against you.

I am sure you esteemed law firm would love the publicity of your ding dong in the paper.

Agh. These are side windows that look directly into your neighbor's home. There is no good view that you're going to get in that situation - who wants to be that familiar with the neighbors? Put blinds up and be done with it already.

I believe the charges against that person were dropped. I remember reading about that case and thinking it was ridiculous. I used to have a girlfriend that used to like having encounters in plain view of anyone walking down the street. I was uncomfortable but she was pretty hot so I went with it. Thank god this was pre-cell phone cameras/video.

And you would lose on both efforts because exposing yourself in view of the public is a crime, the police can arrest you for crimes, and your neighbors can complain about crimes.

You do have a reasonable expectation of privacy in your property, so you cannot be accused of public indecency by a visitor within your home (e.g., the police cannot come into your home and arrest you for indecency for what they see). But, if you do a lewd act that can be seen from a public place (sidewalk), like while standing in your front yard or in an open door or window, then you are committing a crime (you have given up your privacy rights to intentionally expose yourself to the public). And there are a lot of people sitting jail for public indecency committed on their property.

The original scenario (neighbors can see into a home from an adjacent home) is not clear cut because the exposure is visible in another private residence and not to the public. However, judges are not very kind to people who do things in view of kids. So, yes the nudist neighbors could get off, but there is sufficient basis to get arrested and even get past a grand jury, so the neighbors are putting themselves in a very risky situation that could cost them a lot of time and expense that could be easily avoided (paper blinds cost a couple of dollars at Home Depot).

Also, the current situation involves people who are not just glancing casually into a window from the street. They are looking THROUGH THEIR OWN WINDOW, which they have ALSO elected NOT to cover.

This reminds me of the woman who poured hot coffee on herself and then sued because she got burned.

It works both ways you moron. You are projecting a naked image into the neighbor's window.

Completely different then pouring hot coffee on yourself.

You really should not give legal advice. This type of offense is nowhere near the level of severity required to convene a grand jury.

The neighbors are not "projecting" anything. They are living their lives as they choose - which includes being naked and not covering side windows.

OP is doing the same thing by choosing not to cover her windows (she doesn't mention if she, too, is nude) but she wants to make the neighbors cover their windows.

I don't understand why everyone isn't simply telling her to put up blinds. She could just as easily complain "the neighbors can see inside my house because we have no window treatments. How can i make them cover their windows so they can't see us?"

Its a typical D.C. pssing contest. No one wants to be the first to put up blinds, they are happier complaining.

WHAAAAAAA.........

I don't see how you can be in public in a side window of your own home. It could easily be argued that the neighbor who is upset should have put up a blind, kid or no kid.
Anonymous
If your kids see the nudity you can ask for charges be brought and the neighbor to be put on the sex offenders registration list upon conviction. That would make your neighbors put up blinds real quick.

There is no requirement that someone should pay money to buy blinds to avoid looking into their neighbor's home. There is nothing you could do, for example, to force neighbors to coverup ugly decor in their home. There is a requirement, however, that people should not knowingly flash their junk at kids.

Although DCUMers are actively lobbying to change that.

Sorry, but if you don't like the view from your windows, block it. You can't ask your neighbors to put up drapes because you're too lazy or cheap or entitled to do it yourself.
