Must be why he blamed it on his wife.

Just like Menendez. I guess blaming the wife is the one thing the right and left can agree on.

Why is it so hard to believe the wife turned the flag upside down?

Why is it so hard to believe that he knows this is a terrible look and he's throwing her under the bus?

This. I was married to a guy in a public role/job that came with a ton of rules and I was well aware that I needed to be mindful of them too. Optics matter. Professionalism matters.

So, not allowed to disagree publicly with your husband?

My husband was too professional to even express a political opinion. As it should be. He didn’t discuss politics with anyone. His own children didn’t even know where he stood politically until he retired. I shared my opinions with my friends but would never publicly take a position, no. I didn’t volunteer on campaigns until he retired. I can’t emphasize this enough but that is how it should be for roles that are non partisan and it’s sad that this seems to shock people.

That is your choice and it is not shocking at all. Mrs. Alito was allowed to make a different choice.

Do you have the same criticism for Judge Merchant donating to Biden?

The fact that you think we have choices is more evidence that you don’t understand anything we’re saying about rules, ethics, and professional conduct. Yes, it was her choice to create bad optics that make her husband look unethical and unprofessional. I mean, everyone can choose to violate rules, norms, and professional conduct, okay. That’s not a pass. But it was probably him and let’s face it, this is not the only evidence of his lack of integrity and ethics.

NYT and CNN raising this issue now is all about getting Alito to recuse for the upcoming J6 cases. I’m pointing out the stunning hypocrisy of people being OK with judge Merchan not recusing and the stunning hypocrisy of those who think the little woman should just keep her opinions to herself.

When did Alito say he disagreed with any of it? He just claimed to be uninvolved.

Then he was uninvolved. She is allowed to express herself

If he were an ethical, professional judge, he would have said “we can’t hang that on our house, I’m a Supreme Court justice and I need to be impartial and not give even the hint of indication that I may not be”. Maybe she hates him and wanted to make him look bad so she put it up every time he left the house. That’s the only theory that makes sense.

Occam’s razor: he put it up because he agrees with Donald Trump and Sammy Alito feels that he can act with impunity.

He can. The time to do something about Samuel Alito was the 2004 election. It’s way too late now so getting frustrated about it is pointless. But we can do our part to stop the next Samuel Alito by not being bamboozled into voting for Larry Hogan in the 2024 election.

Look there is no will on the democrats’ side to do anything about this. It’s starts at the top with Biden. The cause of this is the apathy within the Democratic Party. Keeping the filibuster is more important vs having republicans puppets on the court legislating from the bench. Democrats think it is 1970’s and the process and procedures(which are broken) are more important vs the outcome.

But we would like Justice Alito to recuse himself from any case that comes before SC that has anything to do with the insurrection or people involved in it. Because the Justice has demonstrated at least the appearance of partisan bias that could affect his ability to adjudicate impartially. Whether that actually happens or not is beside the point. It is the appearance of bias and lack of impartiality that's the problem.

Apart from that, as many have pointed out, this would violate the ethics standards for any public official who needs to demonstrate impartiality, including lower court judges. Unfortunately, noone seems to be empowered to hold SC judges accountable for ethics violations, other than SC itself. Wonder how Roberts will react to this. It must be of some concern to him that the SC is rapidly losing its trust among citizens, which is crucial for the court to retain its status and power, and incidents like this do not help.

Never going to happen. Thomas sits on every case while receiving compensation from parties with interest before the court. No one recused themselves on the Colorado case. One must remember this is why these “5th column” judges were placed on the court.

You’re equating a campaign donation with an insurrectionist flag? How are you okay with what you wrote?

There is no insurrection flag. It was the US flag flown upside down.

In common cause with the insurrectionists. Your gaslighting is absurd.

We can explain it to you but we can’t make you understand it. Spouses of people in non-partisan leadership positions, regardless of their sex or gender, should not be this dumb about professional conduct and yes, they CAN do things that get the person fired.

But let’s stop pretending she did it alone. How about we stop believing it’s always the woman’s fault? He’s not just unethical, he’s a coward.

That's always been a question - what if you just don't follow what the Sup Ct says. They don't have enforcement power.
