Most of you apparently have no logic whatsoever. Well, for what it's worth here's my take... In general the issue is official vs unofficial acts. Official acts are immune from prosecution, unofficial acts are not. So you have to ask the question...was the act, in this case tackling the QB, and official or unofficial act? Is the duty of the linebacker, when the ball is snapped, to tackle the QB? If yes, then he's committed an official act and is immune from prosecution. Is the duty of the linebacker, on the way back to the huddle, to tackle the QB? If no, then he's committed an unofficial act and is not immune. Now, obviously there are gray areas where the claim could be made that the linebacker acted recklessly in the first scenario and immunity becomes unclear. This is when the courts must sort out accountability. This is kind of why SCOTUS sent Trump's case BACK to the lower court once they had clarified immunity. Trump's actions during the 2020 election were determined to be on the "outer perimeter" of his duties, the lower courts now must decide if he is immune to prosecution for those actions or not. |

I like your analogy, but I would consider Trump more of a coach than a linebacker. As a coach his official duty is basically "tell that linebacker what to do." But yesterday's ruling makes little if any distinction between telling the linebacker to tackle the QB (obviously an official act) and telling the linebacker to do whatever he can to overturn the call the ref just made (not an official act). According to SCOTUS, Trump is immune from prosecution whenever the person he instructs to commit a crime happens to be one of his taxpayer-funded minions. It makes no sense that conspiring with Rudy Giuliani can be prosecuted but conspiring with Jeffrey Clark cannot. |
