The funny thing - not actually funny - is that for most of my life, I've associated the regular flag with Republicans. Now I don't. Now if I see a normal flag, I assume it's a normie Democrat, honestly. I think the Republicans have gone so crazy that they're only going to fly the upside flag anymore. Along with w Brandon flag or some other insane thing.

Alito has now become the face of the upside-down flag. Yes, it was a thing before, but now it's really been brought to the forefront of the national consciousness. He's going to be remembered for it.

If you are an American and a patriot, you too should consider the damage that Alito is doing to SCOTUS. That damage is ultimately worse for the United States than for “liberals”. Actually, that was an astute point. Many MAGA types think Judge Merchan can’t be impartial because of his daughter’s political connections, but also think it’s ridiculous for anyone to suggest that Justice Alito should recuse himself from January 6th cases because his wife has a bad habit of flying flags that were co-opted by the insurrectionists.


New York law 100.3 e(1)d(iii) states “a judge shall disqualify himself or herself in a proceeding in which the judge’s impartiality might reasonably be questioned, including but not limited to instances where the judge knows that the judge or the judge’s spouse, or a person known by the judge to be within the sixth degree of relationship to either of them, or the spouse of such a person has an interest that could be substantially affected by the proceeding.”

New York State Bar Association Committee on Professional Ethics, Opinion 673 (1995)(“Whether a judge’s impartiality might reasonably be questioned is necessarily a question of fact in each case. Even if the judge believes that he or she can be impartial, the judge should recuse himself or herself if an objective, disinterested observer could reasonably question the judge’s impartiality.”).

There is a significant factual difference between Judge Merchan and Justice Alito. The fact that the Washington Post passed on the story 3+ years ago is indicative that an objective, disinterested observer would not question Justice Alito's impartiality. The "Appeal to Heaven" flag is a legal flag and until recently flew at the San Francisco Civic Center along with the Gasden Flag (Don't Tread on Me).


Ah the significant factual difference in Republicans' eyes is that Alito is a MAGA Republican and Merchan is liberal. Come on, confess - THAT is the difference in your eyes. You think when a Republican does it, there's no problem.


I'm waiting for you to look at the facts. Instead, you skipped right to political affiliation. Political affiliation - in and of itself - is not enough. There are far more facts that call into question Judge Merchan's impartiality (even assuming we can apply NY ethics rules to a Supreme Court Justice, which we can't).

That is objectivity.


You only need to read Alito’s decisions to know he is not capable of being impartial.

And what I hear you are saying is the SCOTUS does not have strict ethics rules. Agreed. They have none.

Either Alito is slow and he misrepresents earlier opinions to which he refers or he has no judicial impartiality and makes up his mind, then twists the previous opinions to suit what he thinks. Neither is good.

But we know from him flying the Christian nationalist flag that he is not faithful to America.

Hello, welcome to the thread. This has been covered. San Francisco no longer flies the flag that Alito (and several other Republicans) proudly fly because it has been co-opted by the Christian nationalist movement, aka, the GOP.


They only removed it when the Alito controversy happened. It's just not true that the flag was co-opted by the GOP. People decided to make an issue out of nothing.

These are all good. I also liked the one about the irony of Alito being able to control the bodies of women across America but being unable to control his wife's choice of house decor.
