Even if they were charged, any decent defense attorney is going to look for intervening causes for his death to negate causation, which means the nature of the care Diviney's parents provided him would be picked apart and analyzed for any little mistake they might have made. Will it bring the Divineys any peace to go through a trial and have the two men go free because a jury felt like maybe the parents' faulty care taking caused the infection?


No jury is going to let those guys off. The parent's care is the reason why their son lived as long as he did. That doesn't mean that the animals who killed him are innocent or any less responsible for what they did to him. They murdered him.

You don't know that a jury wouldn't find them not guilty, you only know that you wouldn't even consider the evidence before voting to convict. Not everyone shares your biases.

Would there be any chance of saying "but for" the assailants not attacking him, he would not have died?

If you read up on these people, their families are totally in denial. It makes me angry because THIS is exactly what the bullies in grade school look like - that is how they start. They are never taught to control their anger, God knows what goes on in their homes - and then it comes to this. No matter WHAT the innocent victim may have said - nothing, NOTHING, nothing justifies their primitive and violent animalistic behaviors. NOTHING. I hope that poor innocent family put a lien on each of their properties and reminds them what a criminal their sons are every day of their remaining lives. Terrible people, all around, no doubt.

They have gotten away with their behavior long enough. This time, they got caught. May they get theirs, tenfold. That baby, by the way, is going to find out all of this about her father in due time. She is going to find out the truth - not the family handshake secret, but the truth. This is all extremely disgusting - clearly these boys needed help long before this incident. People don't just develop this anger and acting out over night. It was there, and these parents knew it, and they failed their sons miserably. I hope a jury hangs them publicly.

There has to be some sort of precedent or murder by imprisonment would not be in the West Virginia code.

The prosecutors office should find something to hang a charge on so they can bring these guys in. In shackles. Make them wait it out in county jail with no bail. Get the story back on the front pages and the evening news in all its terrible detail. Make their lives hell.
