He isn't currently on the ballot and his appeal to the full court, after unanimous decisions against at the administrative and appeals level is a Hail Mary. His campaign is done. He should have addressed this legislatively sometime in the past decade while he was chair of the committee that oversees the statute. Others had raised this as an issue. He did nothing. Just like he has basically done nothing as a councilmember. Every other jurisdiction has similar requirements to serve as an AG. It isn't just a political position, it is a highly technical legal position as well. |

Which makes no sense. There are 13 members of the Council, emergency legislation needs 75% of those voting to pass. With 13 voting it needs 10 votes, with 12 voting it needs 9. If there are three or fewer opposed it makes no difference if he votes. |

Why would anyone want to support the guy who is running for AG and refuses to use the Fair Election program funding? The guy who got the popular candidate out of the race.

No need to resort to racial slurs and refusing to take taxpayer money isn’t disqualifying. Indeed, I don’t think Mendelson is taking public funds. And McDuffie may have been popular, but he was running for the top legal job in the city, and he wasn’t legally qualified to do so. Spiva followed the legal process to challenge it, and the Board of Elections agreed with Spiva’s legal position. McDuffie appealed to the highest court in the city, and they unanimously rejected his legal position. McDuffie could have gotten re-elected to the Council without much effort, but he chose to seek a position for which he was not legally qualified. Spiva pointed it out, but McDuffie dug his own political grave. |
These are great reasons why he shouldn’t be elected even if he could qualify for the ballot. |
