Hard to say. If McCarthy folds after subjecting himself to six rounds of humiliation he reinforces the perception of his weakness and his speakership is damaged irreparably having already conceded to the demand that any one member can seek his removal. As for the FC, this is red meat for their constituency and they don’t honestly GAF what anyone else thinks of them. It seems pretty clear the FC wants an oversized voice on the Rules Committee and will continue to roll McCarthy at every opportunity just because they can. Gaetz won’t relent unless he gets handed the gavel for Armed Forces subcommittee. There are no winners in these scenarios.

This is an internal matter of Congressional governance. There is no jurisdictional basis for a federal court to rule.

The WhigvParty had largely collapsed and no party held a majority of seats. Also there were 21 memvers serking the speakership. In the end, it was decided to change the voting to award the speakership based on a plurality.

House Republicans need to go into a room and not come out until they have 218 votes for somebody. The number one job of party leaders in Congress is to make sure they have the votes before putting a question on the floor for a vote. Neither McCarthy nor Scalise have been that very good at that.
