The Commonwealth is not disorganized. They disclosed the documents within the time period allowed. The defense asked the judge for more time, and the prosecution is smart to allow for this because if they do not, there could be future petitions filed after the trial for a mistrial. It is within the States interests to make sure they follow all rules and allow the judge to extend time so that the defense can't later on claim unfair treatment. In each and every ruling that the defense has put forth the judge has ruled that no wrong doing has occurred by the Commonwealth or the Fairfax police.

It is the job of the defense to attempt to discredit at every place the police and the prosecutors office. So far they have won NOTHING. It is typical and normal for cases to be pushed out like this. It is actually smart of the prosecution to appear fair in this case. The so called document dump was the defense asking for inner police happenings relating to the catfish theory, which is a reality based on all final evidence. It is normal in most cases to have police officers during an investigation having varied opinions and theories. The defense is throwing mud on the wall and hoping things stick. So far the judge had said repeatedly that the Fairfax department, and the Prosecution has had normal above board behavior. It is simply a case of nothing burger that the defense is trying to turn into a big juicy steak... it is not.

The judge will set the new trial dates on the 15th for January allowing the defense to go over the evidence the legally had time to already go over. They want more time to try to give themselves more time to create a case for a man that murdered in cold blood two people. I assume they need this time because banfield is very guilty of capital murder, the highest type of murder. This is not the fault of the Commonwealth at all, this is how trials are intended to work. The defense and the prosecution have a right to a fair trial. Why place blame on one side when that side is fighting a battle for a very serious crime in a careful and typical way? Stop that sort of rhetoric as it is counter to what is needed by this or any community that seeks justice. There is no need to cast doubt where there is no actual doubt. Let the defense scramble and attempt to create unreal false drama.

Were you at the hearing? Or do you have a link to this information?

No they do not, because what they are saying is conjecture based on false information. This is not a reality at all, which I state the reasons why in another post. There will be no link because this person doesn't understand what happened, what the judge ruled, and the deadline for the evidence given by the prosecution to the defense. If they were at the hearing they didn't grasp what actually happened or why.

Unlike this poster I do know the law, and about the actual case, and I am speaking up because this is smearing the commonwealth and the prosecution unfairly. The court of public opinion is just that but if I possibly can make it clear what is actually happening and support the prosecution, Fairfax County police, and help support justice for Joseph Ryan, and Christine Banfield, I will let people know the reality of the case with a clear and fair analysis of what is actually happening. Critical thinking is important here, especially when court tv and everyone under the sun pretends they know the truth, for them its about creating drama, for me its about the victims, their families, and justice.

I believe how it works is someone can make a case as to why a post is violates the forum rule, such a abusive or slender, or some other reason. It's a forum and not a blog. It's a privately owned website and the moderators have discretion as to what they deem appropriate when a complaint is registered. I have had my own posts removed a few times. I also have made complaints myself. That isn't an odd thing for a privately owned forum to have rules and regulations.

DP. Can you explain why it’s improper? PP isn’t divulging confidential information and what PP is saying doesn’t seem any different than what a newspaper would publish after speaking to a “source” in the courthouse.

(I’m genuinely asking, I’m curious!)

I am the original poster, the notion that what I posted here is improper is not true. I know the case but I am not part of the law enforcement, or a lawyer. I am following the case closely and have been privy to all the public hearings so far. I also have understanding of the law while not being a lawyer. I have said nothing that is outside of what the judge ruled. The poster that suggested I was behaving in an improper manner is someone that clearly is team Banfield. I am team victims, and justice. That person can get a grip on reality, or just stop trying to pretend they know what is legal to say in a forum discussing a case. The smear campaign against the Fairfax county police or prosecution is just that, a smear campaign for the purpose of causing some sort of doubt on them so that the defense can use it as a talking point publicly. It might or might not work but I will keep up defending the team that is trying to convict whom I believe killed Joseph Ryan, and Christine Banfield. I believe the poster is someone that likes Banfield, who that would be is your guess, I am sure I know who that is… but it might just be a misguided person that actually believes that Banfield didn’t brutally murder and plan the deaths of two innocent victims. I have every right to say what I believe is happening, and to talk about what the court has decided up to this point.

RIP Christine and Joe , you deserved so much better.

Wrong! Nothing I said was false or improper, it’s all on public record, and I am not under your personal scrutiny, I am not part of the law at all. I am just not making up crap and smearing the prosecution, or the police. Stop pretending you have some moral ground or legal right to take away my accurate, I must say opinions, and information on the open legal case. My first hand knowledge is from knowing what is going on in the hearings and reporting back in simple terms what the judge has ruled publicly and consistently so far in court.

It is being rescheduled. I will post when I know the date. The judge is granted a continuance, likely in January.
