Nice trying, fool. There's no assumption in the law that every child achieve the save outcome. Again, this is really simple. The legal requirement is that the school provide FAPE. (Btw, DCPS has been up the creek for a couple of decades. It's the reason they're spending hundreds of millions of dollars to send students to private schools. You're an idiot to not know this.) |
| Johnny, Jamal and Juanito can all have 5th grade math served over and over and over. Just because they won't do the work because it's served by The Man isn't a reason for a lawsuit. |
FAPE comes from The Individuals with Disabilities Education Act - it only applies to students with documented disabilities. AND note Free Appropriate Public Education in FAPE. Is someone has an IQ of 50, a school like BASIS is not appropriate nor does BASIS have to provide accommodation. The student will be given a more appropriate placement at a school that can meet their needs. |
Failure to fully understand IDEA is very expensive. Just ask DCPS. |
In a nutshell, that's why BASIS is being sued. It is an LEA and receives taxpayer funding. Those funds are attached to the legal obligation to provide FAPE. "A school like Basis is not appropriate nor does Basis have to provide accommodation" is wishful-thinking at best (for someone who desires a private school but can't afford it) but more likely flagrant offenses against federal law. In any event it's the statement of someone who is obviously ignorant - not merely of the law itself, but also how the legal process works. It's going to be fun watching Basis be torn apart.

It's expensive b/c DCPS has to place these kids at Special Needs schools some of which run 60k+ a yr and provide transportation to and from to meet what is required in the IEP. And DCPS within the past three yrs have cut down by more than half the number of students who are at these schools for whom DCPS pays their tuition. Somehow, it's doubtful whoever is suing BASIS is seeking private placement at a special needs school. |
| Has anyone provided documentation of where DC BASIS is being sued? |
No. It' just anti-BASIS and perhaps anti-Charter propaganda. Registration forms are due on May 1, and it appears as if someone is determined to mount a one-person FUD campaign to discourage prospective families from registering, i.e., "BASIS will be shut down soon because it is not providing FAPE to ALL children..." BASIS is doing just fine and will survive scrutiny. It looks as if they failed to abide by some rules last year regarding the documentation of IEPs, and they might even have failed to provided services to some kids last year. They also managed to have great DCCAS scores in their first year of operation and are on track to be one of the two best performing charter middle/high schools in the city. It's unreasonable to throw the baby out with the bathwater, especially in a city with such a dearth of good middle and high schools. If BASIS is found to have erred last year, they will be ordered to provided compensatory services this year. |
Tell us the truth, PP. What is your wait list number at BASIS? How many people will you have to scare away to get in? |
Oh I have no problem with telling the truth: we're not at Basis, have not applied, and never will. I know much too much to involve my family here. This isn't personal for me, it's more like religion. |
Where, then, do you suggest that the people you dissuade from attending BASIS enroll their kids? Which public or charter school has earned your seal of approval in its handling of 504s and IEPs? Can it accommodate all of the kids who are currently at BASIS or have just gotten in? |
So, in a nutshell, you do not have kids at Basis, you are not interested in sending your kids to Basis. As such, what you truly know is NOTHING. As for your "religion" I think it's pretty clear at this point that your "religion" is anti-charter, anti-high-achieving schools. You're just a vicious and nasty troll, through and through - at this point you've demonstrated and confirmed all of this. There's nothing more to be learned from you. |
You will have their spot. They are not returning. Calm down. Geeesh. |
|
Ok, to sum up:
There is no known lawsuit against Basis. Basis is provided required services. Some people don't like Basis' services. Some people like Basis' services. This whole thread is being driven by a self-admitted troll. Got it. |
