Look at this case. We started with something that was already limited in scope and density, and then the proposal was watered down to the point that very few lots can take advantage of the changes.

It makes 0 economic sense to preemptively build a school or whatever other type of "infrastructure" before apartments are built. It takes years for the need to materialize, if at all. This is not a serious discussion at all. If a county needs a larger school, one will be built. Yes, it will take time and it will be imperfect. But guess what? That is literally how it has happened in this country for hundreds of years. You and your special little neighborhood are not unique.

Just throwing your hands up in the air and saying there is a “housing crisis” so we should deregulate everything and allow anarchy is not a serious solution. School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

So if the school decides to develop this property into apartments, now they are entitled to build 4.034 million sq feet of apartment units by-right. With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

So if the school decides to develop this property into apartments, now they are entitled to build 4.034 million sq feet of apartment units by-right. With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

The request for this bonus density is an administrative process controlled by the state government now. The state of Maryland is required to grant the bonus density unless the administration determines that it will have an adverse impact on health and welfare. The county has basically no say in this decision anymore. Unreasonable basically means anything that precludes the development from having the maximum allowable FAR ratio of 1.625. So parking minimums, height limits and setbacks, could easily fall under this criteria. Lot coverage and impervious surface requirements might be more enforceable because the county can argue the restrictions are not unreasonable and they are necessary to protect the environment/mitigate flooding for surrounding properties. With a 25% site coverage limit requirement it’s not possible to get a 1.625 FAR, with 40 ft height limit. Limiting site coverage to 25% effectively requires 6.5 floors to max out the HB535 allowance for density. So MOCO is potentially looking at a height of around 80ft instead of 40ft when the subject properties are covered under HB535.

Just throwing your hands up in the air and saying there is a “housing crisis” so we should deregulate everything and allow anarchy is not a serious solution. School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

Personally I just rely on the student generation estimates that MCPS and Planning have developed, even though they usually undershoot. The county hasn’t been delivering enough seats. That’s an objective fact. Also it’s planning that decided to second guess MCPS on what level of school overcrowding was too much, because they think being an urban planner makes someone an expert in everything when actually it just means you couldn’t pass the advanced math needed for a degree in architecture or economics.
It makes 0 economic sense to preemptively build a school or whatever other type of "infrastructure" before apartments are built. It takes years for the need to materialize, if at all. This is not a serious discussion at all. If a county needs a larger school, one will be built. Yes, it will take time and it will be imperfect. But guess what? That is literally how it has happened in this country for hundreds of years. You and your special little neighborhood are not unique.

Most people are not opposed to building more housing. They have issues with the scale of proposed zoning changes. The purpose of zoning is to protect health and welfare of residents. Just throwing your hands up in the air and saying there is a “housing crisis” so we should deregulate everything and allow anarchy is not a serious solution. School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

So this means that projects by “qualified nonprofits” effectively don’t need to follow the height limit, setbacks, or parking requirements. For example, the 53 acre Holton Arms School Campus is listed as one of the eligible properties under the ZTA. So if the school decides to develop this property into apartments, now they are entitled to build 4.034 million sq feet of apartment units by-right. With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

It makes 0 economic sense to preemptively build a school or whatever other type of "infrastructure" before apartments are built. It takes years for the need to materialize, if at all. School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

For example, the eligible parcels owned by non-profits are legally entitled to density up 30% above the maximum limit for multifamily zoned areas. Under HB 535, qualified non-profits are also entitled to waivers of development standards that are an “unreasonable limitation” which amount to a “de facto denial” of the project. So this means that projects by “qualified nonprofits” effectively don’t need to follow the height limit, setbacks, or parking requirements. For example, the 53 acre Holton Arms School Campus is listed as one of the eligible properties under the ZTA. So if the school decides to develop this property into apartments, now they are entitled to build 4.034 million sq feet of apartment units by-right. With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

Most people are not opposed to building more housing. They have issues with the scale of proposed zoning changes. The purpose of zoning is to protect health and welfare of residents. Just throwing your hands up in the air and saying there is a “housing crisis” so we should deregulate everything and allow anarchy is not a serious solution. School capacity matters, so do impervious surfaces, pollution levels and noise pollution, access to natural light. The market does not prevent your neighbors from blocking most of the sunlight to your home with a 50 foot zero setback apartment building, nor does it penalize your neighbors for polluting the air you breathe or the water you drink. Markets do not prevent schools or roads from being overcrowded. YIMBYS are ignoring very real costs to residents and they support these policies because they hate single family homes.

For example, the eligible parcels owned by non-profits are legally entitled to density up 30% above the maximum limit for multifamily zoned areas. Under HB 535, qualified non-profits are also entitled to waivers of development standards that are an “unreasonable limitation” which amount to a “de facto denial” of the project. So this means that projects by “qualified nonprofits” effectively don’t need to follow the height limit, setbacks, or parking requirements. For example, the 53 acre Holton Arms School Campus is listed as one of the eligible properties under the ZTA. So if the school decides to develop this property into apartments, now they are entitled to build 4.034 million sq feet of apartment units by-right. With an average size of 1450 sq feet per unit that is around 2,782 units. Previous the R-200 zoning allowed for 124 units, now this parcel is zoned for 2,782+ by-right! A more than 22x density increase is not a trivial change and it will cause a significant burden on the surrounding communities.

Personally I just rely on the student generation estimates that MCPS and Planning have developed, even though they usually undershoot. The county hasn’t been delivering enough seats. That’s an objective fact. Also it’s planning that decided to second guess MCPS on what level of school overcrowding was too much, because they think being an urban planner makes someone an expert in everything when actually it just means you couldn’t pass the advanced math needed for a degree in architecture or economics.
It makes 0 economic sense to preemptively build a school or whatever other type of "infrastructure" before apartments are built. It takes years for the need to materialize, if at all. This is not a serious discussion at all. If a county needs a larger school, one will be built. Yes, it will take time and it will be imperfect. But guess what? That is literally how it has happened in this country for hundreds of years. You and your special little neighborhood are not unique.
