LAPD Chief Michel Moore briefly addressed the shooting in front of the Police Commission on Tuesday, telling the panel, “There’s many more questions than answers at this point.”

“I’ll wait for the full investigation before commenting on the officer’s decision to use deadly force,” Moore said. “The use of deadly force, whether on- or off-duty, is a matter that is the most-scrutinized decision that we have in this organization, and in this instance, it will be as well.”

French was struck by gunfire multiple times. His parents, Russell and Paola French, remain hospitalized in critical condition, the chief said.

“My heart goes out to the parents of Mr. French,” Moore added. “I pray for their recovery.”

The officer — who was identified by multiple sources as Salvador Sanchez, a patrol officer in the Southwest Division — suffered minor injuries.

Los Angeles investigators are assessing whether the off-duty officer, who has yet to be officially identified by the force, violated any department policies in the shooting. Sanchez has been employed with the LAPD since May 2012, according to department records.

If the officer was knocked unconscious during the attack, as his attorney alleges, it would justify the use of deadly force in the incident, said Ed Obayashi, a Plumas County sheriff’s deputy and use-of-force advisor to the California Assn. of Police Training Officers.

The injury makes him a victim of a serious violent felony — one that would likely have made him disoriented, groggy and launched his brain into a “fight or flight” mode — as opposed to a misdemeanor battery in which the injury was not as significant, Obayashi said.

Ultimately, the five-person Police Commission will decide whether the officer was justified in the shooting and whether he followed department rules before pulling the trigger.

Family members of the Frenches are challenging police accounts of the event. Kenneth French was nonverbal and had the mental capacity of a teenager, said his cousin Rick Shureih. French had no history of being violent, he said, and his parents are kind and gentle people.

Civil rights attorney Dale Galipo, who is representing the French family, said there appears to be unequal treatment of police officers compared with other citizens when deadly force is used.

“This is demonstrated by police departments that often cover for their officers and find shootings to be in policy when civil juries find the same shootings to be excessive and unreasonable, and in violation of the United States Constitution,” he said. “Additionally, rarely are any officers charged criminally with the shootings of unarmed people.”

The car was recovered, but not the gifts. The parents promised to reimburse her if she didn't pursue charges. The parents were enablers. They are just as culpable.

Is Facebook a legitimate news source now? And speaking of that, what is your source that the parents were 52? It's been asked repeatedly. They could easily be 60. But then, I guess your justification for turning a Costco into a shooting gallery would be that 60 isn't elderly either.

I looked at her facebook page from back in December, and she posted about it back then. Obviously she had no idea back in December that this would go down.

David Winslow, a lawyer for the officer, told The Los Angeles Times that his client had been shopping with his wife and 18-month-old son when he was knocked to the ground by a large man, later identified as Mr. French, while they were standing in line waiting to taste food samples.

Mr. Winslow, who could not immediately be reached for comment on Tuesday, told The Los Angeles Times that the officer was briefly knocked unconscious.

Dianne Bawit, a 21-year-old student at California State University San Marcos, said she had been shopping for bottled water when she saw a man, who she later learned was the police officer, falling to the ground. She said he had appeared to be in distress.

“He fell pretty hard because I heard a pretty big thump on the ground,” Ms. Bawit said. “He looked like he had a heart attack.”

Ms. Bawit said she initially went to help the officer, but retreated as the altercation escalated.

“He stood up by himself. He pulled out his handgun and starts triggering five to seven shots,” Ms. Bawit said, adding that she was within 10 feet of the men and then took cover. “I was hiding in between the meat aisle, behind the freezer section. I thought I was going to be dead, too.”

People should be able to go to Costco without getting shot by off-duty cops. WTF?!

There were no "elderly parents." 52 is not "elderly."

Also, this isn't the guy's first criminal act. Someone on facebook commented on how the guy stole her car shortly before Christmas, with her kid's Christmas gifts inside. The car was recovered, but not the gifts. The parents promised to reimburse her if she didn't pursue charges. The parents were enablers. They are just as culpable.

Well, if someone on Facebook said it, it must be true.


+1 Seriously. Whomever is posting these posts maligning the dead disabled victim and justifying the shooting of his parent by saying that they're not "truly" elderly needs some counseling to grow a heart and a brain.

Perhaps. and I would imagine that if the video shows he was truly out cold, the defense would go that direction. But to me, it's just another reason why people shouldn't carry around guns as commonly as they do their wallets. So many things that could go wrong in an instant. Three people gunned down in a Costco! And the article below shows that more could have easily been killed as the officer opened fire.

You can't just whip out a firearm and empty a magazine into 3 people because someone knocked you over. And no, the allegation that one of them might have stolen a car once doesn't change that.
