Bi sues and causes hell for one surrogate and the second surrogate had to have a hysterectomy and Bi thinks it was a smooth pregnancy. Can the 2nd surrogate sue Bi for losing her uterus or would the contract have exclusions for that? Can Smith sue the agency for not disclosing that the IP was bipolar? |
In theory the contract should say hysterectomy is a known and accepted risk, but it also said that about fetal death, but here we are. I think Smith did sue for some form of harassment. She has a restraining order and theres an arrest warrant for Bi in Virginia for violating it. She could probably sue for tortious interference with her employment. On the bipolar thing. Probably could try and sue for negligence. Does anyone know where we can read court filings from the other parties, or the judge's decisions? |
