I don't know the whole story but I get the impression he received some more information that swayed his decision. I agree with the folks above who said this is none of my business. That's the truth. DH asked my advice because he was so torn about the incident. He was up a lot last night and I really feel his stress. HR supports the hiring/firing process but they don't make that decision unless it's for an HR employee. This is "at will" employment meaning the person can quit at any time and can be let go at any time except in the instance of discrimination which is not the case here. I've worked for companies where the president very willingly fired anyone he felt was not pulling his/her weight. He was crazy as a loon but he's allowed to do it.

I think this line of thought is the reason people are surprised when they are fired for blogging bad things about their employer/boss. There is no law that says you have to be given a second chance.

Hope the next guy DH hires for this position is really good at what he does; this, or HR eventually realizes that DH fires people rather than actually managing them or resolving issues.

HR needs to tell DH what to do. HR knows the laws of your state. Could this man sue for wrongful termination?
