HR supports the hiring/firing process but they don't make that decision unless it's for an HR employee. This is "at will" employment meaning the person can quit at any time and can be let go at any time except in the instance of discrimination which is not the case here. I've worked for companies where the president very willingly fired anyone he felt was not pulling his/her weight. He was crazy as a loon but he's allowed to do it. |
Very good point. And, yes, DH should punt to HR if there is an HR. |
| The guy is a future problem waiting to happen. Cut your losses now; fire him. |
| You have to give warning or a performance improvement plan before firing someone. |
Nope. No you don't. |
I think this line of thought is the reason people are surprised when they are fired for blogging bad things about their employer/boss. There is no law that says you have to be given a second chance. |
| Hope the next guy DH hires for this position is really good at what he does; this, or HR eventually realizes that DH fires people rather than actually managing them or resolving issues. |
Exactly. |
| HR needs to tell DH what to do. HR knows the laws of your state. Could this man sue for wrongful termination? |
| Sorry, OP. I'm calling troll on this one. You post this morning and then 2 hours later have an update that the guy was fired? Try a little harder next time. |
Nope, only for government employees. |
