+1 Never ceases to amaze me that people walk right behind my car while I have my brake lights on... I've had people even stop behind my car while they were off and I had to honk at them before they noticed. |

OK, but please remember that pedestrians do not have a legal duty to not get hit by cars, whereas drivers do have a legal duty to not hit pedestrians. |
Drivers often cannot see pedestrians as quickly as during the day, especially if the pedestrians are wearing black yoga pants or dark jeans and are pushing a dark stroller. Did you have white or reflective clothing on? Does your stoller have reflective tape on it? I find that putting those blinking lights with a clip on them onto the stroller, that you can buy at running stores, are really helpful. PS: I am not going to give any more details because I want all pedestrians to talk among themselves about being more visible at dusk and at night. |

People also blame pedestrians when they are at fault or when it is pretty transparent that they have an agenda, on DCUM or otherwise. |
I have always held that pedestrians need to be as aware as the drivers do and not think that because they are in the cross walk they are safe. However, if someone was texting or otherwise not paying attention that is wrong. |

Your exactly right PP. It's not much consolation when you're in traction to say "well the car should have seen me". There's some equal responsibility here. As much as the driver should have their eyes open (even in the back of their heads), pedestrians also have a responsibility to be vigilant about their own safety. I can't tell you how many times I've tried to make a legal turn with the light only to have to watch out for some idiot who's walking across the street against the light with their eyes and ears glued to their cell phone as oppossed to what's going on around them. Individual responsiblilty her people, you are a grown up and you can't expect your mom to follow you everywhere you go. |

What are you talking about? I was almost hit once by someone taking a right on red who never bothered to look up from her phone while doing it and I assure you I had plenty of time to notice what she looked like. OP - I think you should reconsider not giving details. If it were my daughter I would absolutely want to know this and take away her driving privileges. |
