So your problem is with MAryland. Virginia doesn't check your record. Doesn't care of Maryland gives safety points or not. Take it up with Maryland if you are that upset. States rights and all.


Virginia is not a state. I am upset as they assign a massive point fine to out of state people for sold purpose of being forced to pay high prices for connected lawyers to get the points back off. Seems they always win if you pay them a few hundred bucks. It is a wallet grab.

Just give me the ticket. And I do live on a cut through on Maryland side. We just have speed traps and redlight cameras and you pay the fine. None of this lets charge a million points, then you hire a local VA attorney connected to traffic courts pay a few hundred then points removed anyhow and you pay the fine.

When I was young 18-25 I got a few tickets. And yes I went to traffic court myself. I got half knocked down or thrown out. No one had lawyers. Lawyers were just for DWIs and reckless and driving like 100 mph. Not for this nonsense.

One for example I made a left turn in NYC where there was a sign no left turn between 3 pm and 5 pm. Did not see sign as old. I had a picture of old rusty sign to show judge. Judge then goes well when cop pulled you over that was an illegal place to park, changing ticket to a parking ticket pay the fine and no moving violation, next. We did not need lawyers for that type of ticket.

I got a ticket upstate NY in a speed trap, went to court and judge said pay ticket and we wont report to state so you get no points.

The small town cop must have wrote 100 tickets that day. The judge knows it is a speed trap and all they care about is the ticket revenue.

This ticket annoys me as three points should be if I was doing something crazy. This is a technical ticket as passing on right on shoulder illegal in VA but since I was never on highway in first place with left indicator on it was a warning type thing. In NYC I would beat this easy at least to get points knocked down l. But in VA it is automatic I lose.

So you weren’t passing anyone and weren’t zippering to get in and also weren’t able to merge because traffic was stopped.

Did you simply run out of lane and travel onto the shoulder and immediately stop to be let in and then got pulled over? That should be easy to argue against the ticket since you didn’t really go more than a car’s length down the shoulder. You can say you were trying to get out of the way so exiting traffic could continue while you waited.

They assign 3 points to everyone. What your DMV chooses to do with them is up to them. So again, you are upset by your choice to live in Maryland and be subject to the rules of the MVA.

In a nutshell, I got on 495 from 123 Northbound. I could not get over. Road 100 percent standstill. I ended up on that small stretch of shoulder between entering and exiting 123. I then decided to go over the short shoulder and get back on 123 headed towards Tysons and go up that way to Georgetown Pike and get back on 495 closer to bridge.

However the exit ramp was jam packed I said screw it, Now at least I have an entrance ramp back on to highway to zipper in and had left indicator one.

At this point still on entrance ramp getting on highway I get pulled over. Cop actually said I saw you go over shoulder and going to let it slide as looked like you were getting off. I said to him that is what I intended. But it was packed and Waze redirected to stay on highway. Given I was blocked getting on to highway in first place due to standstill, then I got redirected to get back on I ended up here. I said I knew what happened was not my intent.

He was nice, took license and registration said let me run it, then he came back with the ticket. Which I was actually surprised he wrote one. From a legal standpoint with that story I did something wrong. But to be honest it is nit picking. I deserved a ticket. But a three point violation I did not. Traffic was not even moving. I was going slow. No one was in danger.
