One of his lawyers, Alina Habba, apparently just said,

“I’m somebody who has been in his office.. I have firsthand knowledge. I have never seen that. That is not the way his office looks.. He has guests frequently there.”

That doesn’t seem super helpful. Or good lawyering, either.

What a complete idiot.

No one thinks Trump had those files out on the floor. They took whatever documents were found in the desk or drawers, and spread them out IN THE ROOM WHERE THEY WERE FOUND, to document what materials were located in the rooms. They were spread out so they could be photographed. The floor is likely the only available space with enough square footage to spread the documents out like that. A large conference table would also have worked.

The shocking thing is that the documents were there, and that apparently this woman was admits she was frequently in the office and would have had access to them. They were absolutely not secure in that case.

Is she a lawyer?

My understanding of the PRA is that Trump doesn't own any of the records from his administration. Is she just lying or a complete idiot?

And if the records are "declassified" as she claims, why aren't they marked as such? Why is there no official record of Trump declassifying them? And why are these records in a location that's not secured? How is that not illegal?

And doesn't she see the ruler and the card in the photo identifying these items as evidence? Pretty standard police procedure as I understand it. How could she not know that?

Can she be disbarred for being stupid? Ignorant of the law? Lying on TV?

Trump's lawyers completely forgot to argue for why the court should enjoin the government from continuing to review the seized materials. They argue in the supplemental brief that Judge Reinhart doesn't have authority to grant the injunctive relief in the other proceeding because he's a magistrate, but they don't address the merits of their request for an injunction in the supplemental brief and they don't make a single reference injunctive relief anywhere in the reply brief.

Why are these lawyers so bad at lawyering?

It’s not simply a matter that she would have had access but rather she submitted a declaration to a NY court stating that she inducted a thorough search of the records in every room of his residence at MAL on May 5.

I assume you are not a litigator.

Proposing a framework doesn’t mean DOJ thinks a Special Master is likely or appropriate. The court specifically asked the parties to provide proposals in the event she grants the request for a special master. Even if DOJ believes she would be dead wrong to appoint one, they would be idiots to skip providing a proposal and thus let Trump call all the shots if one were appointed.

Federalist Society through and through. Her career advancement depends in a Republican in the WH. She doesn’t want to spend the next 25 years sitting as a district judge in West Palm Beach of all places.

DOJ would need leave of court to appeal an interlocutory order. And if you think the 11th Circuit will be any less deferential to Trump well …
