A tort suit with damages for speech is government interference.

I see your logic, and I can imagine a universe where our courts could have precedent that said 1A prohibits defamation suits.

But we don’t live in that universe.

Ummm yes we do. 1A is a defense in defamation suits. NYT v Sullivan.

It doesn’t kill defamation suits categorically. It’s just a limitation on them.

I scanned the article. Just a bunch of receipts about how this boy hoarded this bike all day long undocking and redocking to avoid paying the fees. It wasn't his at the time the PA rented it he doesn't have a right to monopolize it all day and as the mother said, there were other bikes. Surely the boy can use different ones too. Citi Bike might need to tighten the rules to avoid the abuse of bikes in this way.

Thanks. I was concerned Monique would use the interview as an opportunity try to develop a defense for her own potential defamation suit. Although I was hopefully she isn’t smart enough for that, and apparently she’s not, because that’s helpful discovery for Comrie.

Summary:
- Boy is 17
- Mom is angry people are calling her baby a “thug” on the internet
- Boy claims his receipts “prove” his side
- Boy says he rides citi bike all over town in increments of 45 minutes then redocks them to avoid paying increased fees
- Boy admits he docked bike at 7:19. His 4 friends were sitting on docked bikes and he was standing next to “his”
- He says nurse came and asked to take docked bikes and they all said no
- He claimes nurse scanned “his” bike and “pushed her way on it”
- He *admits* that he physically pushed her back into the dock! “ During the filmed part of the interaction, Michael was able to successfully push the bike back into the dock”
- A lot of hyperbolic claims that “my boy could have gotten shot!!!” and crying about the stress of the negative publicity

Curiously absent: any mention of who put the video online and what responsibility they bear.

Well Monique is now more focused on how the nurse was “weaponizing white womens tears” in her reaction to a “disagreement” - so now we are all more in the realm of opinion, not defamation.

Of course the absolutely hypocrisy is Monique going on and on about how upsetting and bad it is for the boy to be attacked on the Internet! While of course neglecting to mention that he or his friends put the clip online AND that Monique was probably the #1 reason the flames were fanned against all parties.

I was surprised she presented the PA's side, even if she only gave them a few sentences. Monique put in the mom's mouth all the stuff about "she's a rich white woman who was going to get my son killed by the police."

I wonder if Monique is taking legal advice.

Good summary. They also admit, buried deep in the interview, that it was an e-bike and that's probably why the pregnant PA wanted it.

Monique has the mom saying the hyperbolic stuff. I wonder if the mom actually said half of that, but we'll never know.

But that's what the boy and his family are mad about. "We're just poor immigrants!" They want a piece of that pie as well. Why doesn't Monique put her money where her mouth is and start a gofundme for him and make the first big fat donation?

+1. If Monique and Crum has just waited for all the evidence, this would have died a quick death. It is a bit rich to complain that someone is being hurt because of your own actions.

But she absolutely called the nurse a thief a few days ago.
