Why in the world is he taking this to trial?! I suppose juries can do anything, but it seems highly unlikely they'll be in agreement that the unlicensed 18-year old driver going 81 in his BMW isn't the one responsible.

Also, I wonder if this could open the door to the parents' being held liable civilly. It's a high bar, but if they knowingly let him drive in a manner disallowed by his permit, that seems problematic.

How could the parents be held responsible for the actions of an 18 year old?

When my 18-year old only had a permit she didn’t have access to car keys since she could only drive with one of us.

Put his parents on trial next, 4 days before the crash, they bought him the BMW he used to drive 81 in a 35mph zone and hit three people in a crosswalk. They knew he didn't have a driver's license. They let him drive it to school and back resulting in the death and injury of three people."

No idea if all of that is true (we know the part about the learner's permit is). But if the parents did, in fact, buy him the BMW and let him drive it to/from school despite his being unlicensed, then they might be liable in a civil lawsuit. It's a Class 1 misdemeanor to let someone drive a car if you know them to be unlicensed. The parents seem like they have extremely poor judgment, which might explain why they're paying a defense attorney to try this before a jury.

If that's true he was breaking the law by driving unsupervised by a licensed driver. The county bears some responsibility for not enforcing that.

No the parents do for giving him their car. But he was 18. Why wouldn't he have his license?

A lot of kids around here do not get their license until they are 18.

I dont know a single one. I have 3 kids - all of them - and every one of their friends - wanted their license as soon as they turned 16.

Statistically, that's not the norm anymore. Plus, you can't even get your license when you turn 16. You have to be 16 and 3 mons MINIMUM.

But, yeah ... kids don't need to go places as much anymore b/c of the internet. And they don't want to drive as much as they used to. It's difficult to drive in the DMV -- so a lot of kids want to put it off. Neither of my kids WANTED to get their permits or licenses, but I insisted. Another friend's oldest didn't do it until she was 20. Their other kid was chomping at the bit when she was 15.5 yrs for the permit. Lots of kids are just not that interested, and there are other options (public transport and uber).

If the parents knew he didn't have a license, and encouraged or allowed him to drive without a real license, they are definitely in big trouble at least on the civil side. I'm sure they will say they bought it for him, but didn't know he was going to take it until after he got his real license.

He took TWO lives. So very reckless.

Closing arguments tomorrow morning.

Not a lot if kids without a license at 18 where the parents buy them a BMW. If they are waiting that long it usually means they either don't need a car very often or are a bit immature.

I have to admit I am just gobsmacked/mind blown at how this has played out. He didn't have a license? The defense called one PI as a witness?

Insane to take this to trial. This closing is going to be brutal for the defense.

Did he have to post bail (for the past two freaking years while the girls families suffer)? Did he have to surrender his passport?

Didn't he go off to college?

I think I read in this thread or another one that he’s at Virginia Tech.

Driver was unlicensed, so is this why his insurance did not pay the girls’ families?

How can the parents be blamed for the action of another adult? Can they not claim that the driver took the car keys without their knowledge?
