Effectively immediately means that as of COB today he no longer a US congressman and DeSantis can immediately fill his post until Florida holds a special election. It also means that the republicans will not miss that vote. Remember there is a big government funding budget coming up in December.


Are you sure DeSantis can replace him? That’s not how it works in most states. The seat usually stays open until there’s a special election.

Yes he can try to do this through a recess appointment but the timing of that is a significant too. The debate has to be recessed for 10 days before a recess appointment. But they have Trump's entire cabinet AND the tax cuts to get through. You can't do it all at once. Plus pushing Gaetz through as a recess appointment is bound to piss off people in the caucus (especially in judiciary, simply because it deprives them of a time to shine) at a time when he needs their votes on other things.

Maybe this is four dimensional chess but also maybe he's just stupid. Or maybe he owes Gaetz for something and this is the reward even though it's unlikely to work.


Where are you getting this 10 day thing? I think the real issue with recess appointments is that the senate has to vote to go into recess, and if 4 Rs think Trump will use the recess to put in people like Gaetz then they won’t agree to do it. That of course would require 4 Rs with spines and I don’t think I’ve seen 4 of them in many years.

The Supreme Court held in NLRB v. Canning that a recess of 10 days or less was too short to fall with the recess appointment power because the power was created to enable functioning of the government when the usual means of confirmation. Is unavailable. A recess of fewer than 10 days was deemed too short to consider debate confirmation "unavailable."

Bunch of DOJ officials being quoted anonymously and being very critical of the MG nomination.

Ignoring the substance of their critiques this is simply highly unprofessional behavior. I don’t like the nomination either, but DOJ employees must be extremely apolitical and this kinda of thing pisses people off.
