Supreme Court Hearing on 14th Amendment and Trump

Anonymous
How likely is it that 6 justices will agree that Trump has complete immunity? Sadly, 100%, Roberts. Alito. Thomas. Gorsuch, Barrett, and Kavanaugh just turned us into a monarchy with Trump given the divine right of kings. God help us.

I didn't think there was anything to this. Until I looked at the 14th amendment. It's written there, clearly spelled out. Trump is disqualified.

Is this a fringe argument? Nope. It's one of the most important amendments to the constitution.

Except for the fact that the amendment refers to officers not the president.

Yes just like the constitution does not say Obama can not be president again. It refers to person not Obama.

This argument is like saying a court in a single state can decide for itself that Obama wasn’t born in the US and strike him from the ballot and Congress couldn’t do anything about it. I don’t think the court will allow states to determine the qualifications for presidency, only congress can. Let’s see how they rule - I have no doubt Colorado will lose, but curious what the rationale they decide upon will be.

That would be appealed and overturned in an instant. That’s why Courts of Appeals and SCOTUS exist, to overturn dipshit lower court and state judges who make dipshit rulings.

Like Colorado.

It wasn’t an insurrection. It was a protest that started off peaceful and then turned into a riot.

See? By refusing to do their job, the Supreme Court is fueling this stupidity.

Isn't it horrifying how one man can wreck all of our institutions because...of his strong personality?

It's pitiful. The Supreme Court is pititful.

No one has been charged let alone convicted of insurrection.

All three levels of the Colorado judiciary determined after a weeks long civil proceeding that Trump engaged in an insurrection.

So you are saying that a red state could kick Biden off the ballot if the courts in that state just decided that his actions, for example, with respect to Iran (or maybe his actions to have DOJ prosecute his political opponent) constitutes an insurrection? And every state gets to decide whether Trump or Biden can be on their ballot? Quite the can of worms.

What Biden did in Iran could only be an "insurrection" if words have no meaning at all. If night means day and black means white. What he did in no was was an attempt to violently overthrow our government

It was a protest against the results of an honest election, with an aim of stopping the legitimate transfer of power. So yes, it was an insurrection.

It's going to be glorious seeing Trump win the election and then fail to negotiate the 2/3 votes needed to remove his insurrection disability. Any idea if it would pass to Biden or would it go to Trump's VP?

Words have meanings. Insurrection, for one. "Blah blah actions with respect to Iran" does not even remotely constitute insurrection. Trying to overthrow a legitimate election is MUCH closer to insurrection. Laughable to try and stretch it to Biden. If a state did this, they would be declaring their own complete illegitimacy.

Any interpretation suggesting one is not an "officer" while serving as President would be a complete joke. The 14th Amendment literally refers to removal of the President FROM OFFICE.

It's right in the Constitution. It's literal, and it's crystal clear.

Whatever Roberts thinks he can pull out of his butt to interpret it differently will be coming out of his colon, not the Constitution.

Yea I mean once Biden wins they may need to just double the number of Justices and put people in who don't quiver in fear of MAGA

People were murdered. They had erected a gallows and were calling to hang Mike Pence. If this isn't an insurrection then what the hell is?

There were charges of seditious conspiracy. If it was just a riot, then those Proud Boys wouldn't have been charged and convicted of it.

There was nothing peaceful about the start of this mob called for by trump.

Sorry.

Might as well just crack open that case in the National Archives and set the Constitution on fire, since the words CLEARLY written on it apparently now mean absolutely nothing to SCOTUS.
