I think it's implausible that the non-garage townhomes were sold without assigned parking spaces. Few if any people would buy them that way. My belief is backed up by the HOA's page explaining that the spaces for these townhomes were assigned in the Final Site Plan:

I'm not a lawyer and have no opinion on the merits and the course of the lawsuit. But I do think the indignation against the Board regarding parking spaces is unjustified.


Homes in the DMV are sold all the time without garages and at a premium. There are very few garages in areas like Old Town and Georgetown. The current trend is to discourage individual vehicle use/ownership and exchange for more housing that is afforadable and use of public transportation. The ungaraged townhomes signed up for a car-free lifestyle.

AI is telling us this thread was started by an ungarage town home owner in Potomac Yard and 95% of these ungarage owners are planning their exit.

Ungaraged homeowner here. Not planning to leave at all. Bc I know this case is a loser. And my HOA dues will probably go down after Frank loses, has to pay attorneys fees, and then moves himself out of embarrassment. He’ll likely be out about $75,000 - $100k from this debacle, defending on how many times he appeals (and loses).

He’ll be paying for his attorney’s retirement home in Florida.

It's to be expected that the HOA lawyer will tell the board whatever they want to hear to keep the account. I believe their primary focus is on billable hours, and they may not prioritize the client's success. I am guessing this is where your confidence is coming from. This needs to be handled differently from *Batt v. Manchester Oaks*. Yawning.

Batt v. Manchester Oaks was totally different. That case is not even on point. The court is gong to be upset if Frank’s attorney keeps relying on that case without acknowledging the differences.

Yes, of course, HOA lawyers do not make money when issues like assigning parking spots unequally is resolved.

Are there any tax benefits for residents in this community, particularly regarding the rules on items such as bird feeders, garden flags, and string lights. Could you please clarify if there are any tax breaks associated with living under these community guidelines?

Additionally, I would appreciate it if you could explain the benefits of living in this Homeowners Association (HOA) if there are no tax advantages.

I am guessing he loves most your neighbors across the street who get towed for parking in front of their own house even though they pay to maintain those spots.
