SUSPENDED from WORK for being PREGNANT

My sister was suspended from work two weeks ago because the doctor wrote a note requesting light duty. She works at a center that requires heavy and light lifting. Prior to the doctor's note, she had spoken to the HR requesting to be transferred to a floor that did lighter lifting. The HR told her that she had to be on that floor for 30 more days ( to finish her 90 days probation) before she could be moved. When she presented the doctor's note, she was told to go home they were going to contract her once they created a position for her. It has been over two weeks now and she has heard nothing. She has driven to the office, made several calls but they keep telling her to wait. She will be due in about 3 months and it seems like they are trying to frustrate her so that she can just quit cos if they fire here they risk a discrimination lawsuit. She does not have money to hire a lawyer. What steps should she take? Thanks in advance.

Didn't you already post this earlier this week? You were told emphatically that there is no unlawful discrimination if she cannot perform the duties.

OP, are you now pretending to be the sister of someone else? didn't you JUST post on this in the expectant mom's forum?? changing small details in your story doesn't change the outcome..

Shes trying to get people up in arms with her title, but once people open it up they realize this has already been posted and her office is doing nothing wrong. Epic fail op. Now you are just embarrassing yourself.

OP, your sister should go to the local office of EEOC now and file a claim of discrimination. She does not need a lawyer to do this. She needs to do this quickly before her time runs out.

2 Pps...you need to read the original post last week posted by the actual woman. It is more detailed and there is no way she can file for discrimation. She works a job that requires heavy lifting and has not even been there 3 months so is still in a probationary period. Her doctor wrote a note pretty much saying she cannot do her current job. She has been put on suspension until they can find another job. No discrimation there. Sorry, but I don't understand why a new post was created. She just posted a week and a half ago.

OP, I just read the thread people are referring to which I had missed before. Is that you? If so, I am sorry people are being mean to you. If you are the sole breadwinner of your family and suddenly find yourself out of work, that is really, really hard. I imagine you must be very scared right now.

It does't sound as if you have any legal recourse, though. I wonder if you could contact some church groups or right to life people who help people with crisis pregnancies -- this certainly qualifies as one.

Not that it matters, but I'm wondering why she would take on a position requiring heavy duty knowing that she is pregnant. There is nothing she can do but wait it out or find another job. She has not been fired, she is still within their system, so not discrimination.

Maybe she is young, felt invulnerable, and this is her first pregnancy and she didn't realize how hard the lifting was or that she wouldn't be able to work up till her due date.

Maybe she thought that they'd be able to mover her to light duty if she needed it?

Maybe she really really really needed the job to pay the rent, and just took it hoping for the best?
